279 day is given to the aforesaid David Johnson here also &c Att Which said next Court to witt the sixteenth day of March Anno Dom One thousand Seven hundred and thirty five Came againe as well the afd David Johnson as the afd Thomas Wise by their attorneys afd And whereupon the same Thomas prays further Leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the afd David here also &c Att which said next Court to witt the fifteenth day of June Anno Dom one thousand seven hundred and thirty five ^six^ Came againe as well the afd David Johnson as the afd Thomas Wise by their attorneys afd And Whereupon the same Thomas prays further Leave thereof to Imparle here untill next Court and he hath it and the same day is given to the afd David here also &c Att which said next Court to witt the seventeenth day of Augt Anno Dom one thousand seven hundred and thirty six Came againe as well the afd David Johnson as the afd Thomas Wise by their attorneys afd and the said Thomas [illegible] defends the force and Injury when &c and Saith that he doth not detain from [illegible] the negro afd in manner and form as the said David above against him hath Complained and of this he puts himselfe upon the Country &c And the afd David in Like manner Thereupon It is Commanded the Sheriff of Somerset County that Immediately he should Cause to Come ^here^ before the Justices of his Lordships County Court of Somerset now Sitting at dividing Creek in the County afd Twelve &c by whom &c and who neither &c to recognize &c because as well &c and afterwards Immediately Came thereof the Jury &c and the Jurors of that Same Jury by [illegible] McClester Gent sheriff of the County afd to this Impannelled being Called Came to witt Thomas Dixon John atkinson George Tull Joseph Gray William Mills George Howard Joseph Hall John Jones Robert Givans John Webb John Davis and Joshua Caldwell who to say the truth of the premisses afd being duely Elected Tryed and Sworn upon their Oath say that Robert Johson by his last will and testament duly Executed bearing date the XXVII day of January Anno Dom MDCCXVII amongst other things did devise a negro woman slave then belonging to the said testator Robert Johnson to his son Arthur Johnson since dead Intestate whose Administrators the pltiff is we further say that the negro Cæsar in the declaration mentioned is a son of the said woman [illegible] so as afd devised and born after the death of the said testator Robert Winston we further say that the said negro Cæsar Came afterwards into the possession [illegible] Thomas Wise that the said Arthur dyed Intestate and that Administration of the said Arthurs Estate was in due form of Law committed to the pltiff Levid by Nehemiah King Gent deputy Commiss^ary^ of Somerset County and that after such Administration Commited and before the test of the original writt In this Cause the said David demanded the said negro Cæsar of Thomas Wise |
