27 on behalfe of his Lordship the Lord Proprietary against John Calinan of and Concerning of his feloniously stealing One Pockett Book and three pounds One shilling and Six pence in bills of Creditt &a Whereupon a Certain John Teague of Somerset County planter present here in ^Court in^ his proper person undertook for the said William Teague and acknowledged himselfe Indebted unto his Lordship the Lord proprietary in the sum of twenty pounds Sterling good and Lawfull money of England of his goods and Chattells Lands and tenements to be made and Levied to the use of his Lordship his heirs & Successors If it Happen that the afd William Teague do not make his personall appearance before the Justices of the next assize nisi prius Oyer and terminer and Goal delivery to be held at dividing Creek the first tuesday of September next and do not then and there give such evidence as he shall know against John Callinan of and Concerning his feloniously stealing one pockett Book and three pounds one shilling and Six pence in Bills of Creditt of and from a certain John Reddish and do depart the Same Court without Leave &a then &a
in the full and just sum of Sixty seven pounds Eight shillings and Eleven pence Currant money to be paid to be paid unto the said Richard Samuels and Martha Samuels orphans as af.d their heirs Ex.rs Admrs or Assigns to the which payment well and truly to be made and done we bind our selves our and Either of our heirs Ex.rs and Adm.rs for the whole and in the whole Joyntly and Severally firmly by these presents Sealed with our seals and dated this 17.th day of June Ann Dom 1735 The Condition of the above obligation is such that whereas the Comissary Generall hath transmitted unto this court the Account of the Estate of Richard Samuels dec.d wherein it is found that there is ball due to the abovesaid orph Orphans the sum of thirty three pounds fourteen Shillings & five pence halfe penny Currant money if therefore the abovesaid Ann Samuels her heirs Ex.rs or Adm.rs shall do well and truly pay or Cause to be paid unto the above named Richard Samuels & Martha Samuels orphans as af.d the af.d sum of thirty three pounds fourteen Shillings & five pence half penny to be paid them according to the dec.d will and the act of assembly in such Case and provided when they shall arrive at full age to receive the same then the above Obligation to be void and of none Effect Otherwise to stand and remain in full force and Virtue in Law &a her Signed sealed and delivered Anne X Samuels (seal) In the presence of us mark Willm Stoughton Jos: Macclester (seal) Jn.o Waters Daniel Jones (seal) |
