279 his Costs and Charges by him about his Suit in that part [illegible] pounds Sixteen Shillings Current money of maryland and for those Costs and Charges to one pound of tobacco Therefore it is Considered that the afd Robert Mccfarling recover against the aforesaid Charles Ramsey his damages afd to the afd Ten pounds Sixteen shillings Currant money of Maryland and One pounds of tobacco by the Jurors afd in form afd assessed as also Eight hundred and fifteen pounds of tobacco to the Same Robert at his request for his Costs and Charges afd by the Court hereof Increase adjudged which Certain damages in the whole ^do amount^ to Tenn pounds Sixteen shillings Curr.t money of Maryland and Eight hundred and Sixteen pounds of tobacco and the afd Charles in Mercy &c
which from him he unjustly detains &c And whereupon the said David by Geo: Douglas his attorny says that whereas the said Arthur in his life time to wit on the first day of Janry Anno Dom seventeen hundred and nineteen at Somerset County within the Jurisdiction of this Court was possessed of the said negroe named Cæsar of the value of forty pounds Currt money of Maryland as of his proper negroe and being so thereof possessed afterwards to wit the day and year afd at the County afd the same negroe to the said Thomas did deliver to be by him safe kept and by the said Thomas to the said Arthur to be redelivered when he should be afterward thereto required Nevertheless the said Thomas the said negroe to the said Arthur in his life time altho afterwards in the day and year afd at the County afd and often afterwards therein required did not deliver [illegible] since the death of the said Arthur and Administration of the Estate of the said [illegible] David in due form of Law granted hath not delivered altho thereto afterwards [illegible] day of August Anno Dom seventeen hundred and thirty five and often [illegible] the said David thereto required but the said negroe to the said David to deliver hath denyed and still doth deney and unjustly detain whereupon the said David says he is the worse sixty pounds Currt money of Maryland and thereof he brings suit &c And the said David brings into Court here letters of Administration &c which testify &c pledges dep.s J Doe & R Roe And the afd Thomas Wise by Francis Allen his attorney Cometh and defendeth the force and Injury when &c and prays Leave thereof to Imparle hereuntill next Court and he hath it and the same day |
