270 Solemnly Called Came not but made default and did depart without Leave of the ^same^ Court &c James Houston appears according to his recognizance to give Evidence against Saul Townsend and ins discharged therefrom &c
Whereupon a Certain Thomas Lambden of said County Merch.t present herein Court prays further Surty's of the peace against the said Nathaniel Brittingham and makes oath to the Same &c Thereupon the said Nathaniel Brittingham is ordered by the Court here to give new security for his good behaviour and appearance at March Court Next &c Whereupon the said Nathaniel Brittingham with William Lane of Somerset County Gent his security both present herein Court in their proper persons acknowledged themselves Indicted unto his Lordship the Lord Proprietary Twenty pounds Sterling Each of the good and Chattells Lands and tenements Severally to the use of his said Lordship his heirs and successors to be made and Levied If it happen that the said Nathaniel Brittingham do not make his personall appearance before the Justices of his Lordships County Court of Somerset to be held at dividing Creek in the Same County the third Tuesday of March then next to answer unto his said Lordship the Lord Proprietary of and Concerning such matters and things as should be then and there objected against him on his said Lordships behalfe and do not stay and abide the Judgment of the Court thereon and do depart the Same Court without Leave and in the meane time if he be not of the good behaviour towards his said Lordship and all his good people &c
of the County afd that is to say the said Charles Dickerson did acknowledge himself to owe unto his said Lordship the sum of tenn pounds Sterl to be levied on his goods and Chattels Lands and tenements for use of the said Lord proprietary his heirs and Successors in case he fail in the Condition Under Written The Condition of the above Recognizance is such that if Mary Mayho do and shall make her personall appearance before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of November Next to answer unto his said Lordship all such matters and things as shall be then and there objected against her for the bearing of her body a bastard Child and not depart the Court without Leave then this Recognizance to be void otherwise to be and Remain in full force and vertue taken before me the day and year above Jno Scott att |
