26 and John Britt of and Concerning their feloniously ^stealing^ our negro Boy of the proper goods and Chattells of his the said John Pitts and do depart the same Court without Leave &a then &a Likewise the said John Pitts Jun.r with John Fleming of Somerset County planter his Security both present herein Court in their proper persons acknowledged themselves Indebted unto his Lordship the Lord Proprietary in forty pounds Sterling Each good and Lawfull money of England of their Severall goods and Chattells Lands and tenements Each of them to the Use of his said Lordship his heirs and Successors to be made and Levied If it happen that the said John Pitts Junr do not make his personall appearance before the Justices of the next assize nisi prius Oyer and terminer and Goal delivery to be held at dividing Creek in the same County the first tuesday of September next and do not then and there give Such Evidence as he shall know against Thomas Lambden Sarah Lambden and John Britt of and Concerning their feloniously stealing a negro ^Boy^ of the proper goods and Chattells of the afd John Pitts the Elder and do depart the Same Court without Leave &a then &a Likewise the said John Gouty with John Pitts of Somerset County planter his security both present here in Court in their proper persons acknowledged themselves Indebted unto his Lordship the L.d prop.ry in forty pounds Sterling each good and lawfull money of England of their Severall goods and Chattles lands and tenements to the use of his said L.dship his heirs and Successors to be made and levied If it happen that the said John Gouty do not make his personall appearance before the Justices of the next assize nisi prius Oyer and terminer and Goal delivery to be held at dividing Creek in the same County the first tuesday of September next and do not then and there give such Evidence as he shall know against Thomas Lambden and Sarah Lambden and John Britt of and Concerning their feloniously stealing a negro ^Boy^ of the proper goods and Chattles of the afores.d John Pitts the Elder and do depart the same Court without leave &a then &a
