257 the said John Wheeler is Committed into the Custody of the Sheriff of Somerset County thereto remain &a the said sher to witt Joseph Macclester ^by Francis Porter^ deputy present herein Court took Charge of the said John Wheeler accordingly &a Joseph Allen of Somerset County planter being Sommoned for to appear at this Court to answer his not burning tobo according to act of assembly in such Case provided &a and foras much as it doth appear to the Court here that the said Joseph Allen hath not burnt so much tobacco as by Law he was Obliged to burn &a Wherefore it is Considered by the Court here that the afd Joseph Allen pay unto his Lordship the Lord Proprietary for his fine for and by occasion of the premisses afd Twenty Shillings Curr.t money of Maryland and that he be taken &a
the third Tuesday of June ^then^ next to answer unto Charles Henderson ^Jnr^ of a plea of trespass upon the Case &a and that thereof he should not fail &a Att which said third Tuesday of June to witt the fifteenth day of the Same Month anno Dom One thousand seven hundred & thirty Six being the day of the return of the said Writt Came the said Charles Henderson Jun.r by Francis Allen his attorney and the Sheriffe of Somerset County to witt Joseph Macclester Gent Likewise Cometh and Reurned that by Virtue of the writt afd to him directed he had taken the body of the same Hugh Purkins whose body before the Justices of his Lordships County Court of Somerset at the same day and place in the writt afd mentioned he had there ready &a And ^the said^ Hugh Purkins by George Douglas his attorney Comes and defends the force and Injury when &a and prays Leave to Imparle ^hereuntill next Court^ and he hath it and the same day is Given to the afd Charles Henderson here also &a Att which said next Court to witt the Seven^teenth^ day of August anno Dom One thousand Seven hundred & thirty six Came againe as well the afd Charles Henderson as the afd Hugh Perkins by their attorneys afd and because the afd Charles Henderson did not prosecute his writt afd against the said Hugh Perkins Therefore he and his pledges of Prosecuting are in mercy and Lett the plft name pledges &a and that the afd Hugh Perkins goe thereof without day and also it is Considered that the afd Hugh Perkins recover against the afd Charles 161 Henderson Jun.r his damages by occasion of the premisses afd to pounds of tobacco to the same Hugh by discretion of the Justices here at his request for his Costs and Charges in that part Sustained according to the form of the Statute &a p the Court here adjudged &a
