257 Wherefore it is Considered by the Court here that the afd John Mitchell pay unto his Lordship the Lord Proprietary for his fine for and by occasion of the premisses afd three pounds Currt money of Maryland &a Thomas Caldwell of Somerset County planter present herein Court in his proper person undertook for the said John Mitchell for to pay the severall officers their fees due by means of the premisses afd William Adly of Somerset County planter Came hereinto Court in his proper person according to a Certain Writt of attachment against him Issued for not appearing at June Court Last he being Legally Sumoned thereto for not buring of tobacco according to act of assembly in such Case provided and foras much as the said William Adley hath nothing to Object that was Materiall but was willing to pay his fine for the fact afd &.a Wherefore it is Considered by the Justices here that the afd William Adley pay unto his Lordship the Lord Proprietary twenty Shillings Curr.t money for his fine for and by occasion of the premisses &a & that he be taken &a John Ruark Late of Somerset County planter came hereinto Court in his proper person according to a Certain Writt of attachment against him Issued for not appearing at June Court Last he being Legally Sumoned thereto for not burning of tobacco according to act of assembly in such Case provided and for as much as the said John hath nothing to Object that was Materiall but was willing to pay his fine for the same Wherefore it is Considered that the said John Ruark pay unto his Lordship for his fine for and by occasion of the premisses afd twenty Shillings Currt money of maryland and that he be taken &a Thomas Caldwell security for fees &a Forasmuch as William Mark Dorman of Somerset County planter had not burnt ^so much^ tobo as by Law he was Obliged to burn but was willing to pay his fine for the same &a Wherefore it is Considered by the Court here that the afd William Mark dorman pay unto his Lordship for his fine for and by occasion of the premisses afd this Twenty Shillings Curr.t money of Maryland and that he be taken &.a John Wheeler Late of Somerset County planter being sumoned for to appear at this Court to answer his not burning tobacco according to Law in such Case provided &.a and for as much as it doth appear to the Court here that the said John Wheeler hath not burnt so much tobacco as by Law he was Obliged to burn &a Wherefore it is Considered by the Court here that the said John Wheeler pay unto his Lordship for his fine for & by occasion of the premisses afd twenty Shillings Curr.t money of Maryland and thereupon the said John Wheeler is ordered by the Court here to give Security for the payment of the fine afd and the severall officers fees due on the premisses afd but for want thereof the |
