258 since that time hath very much wasted the said Estate so that your petitioner is Very Likely to be a great Sufferer by means of his being such her Security that the said John Donelson ^as^ for by these Severall months past Left and departed Government and probably will never the return so that your petitioner is in all probability Likely to be the Sole Sufferrer by means of the premisses In tender Consideration whereof your petitioner prays that the said Katherine may be decreed by this Court to give to your petitioner sufficient County Security to Indemnify him by means of the premisses or otherwise relieve your petitioner according to the directions of the act of assembly in that Case Lately made and provided and your petitioner shall pray Thereupon Command was given to the Sheriffe of Somerset County that he should somons the said Katherine Stewart so that she ^might^ be and appear here Immediately here in Court to answer the petition afd of the afd Robert Hodge &a Whereupon afterwards to witt the seventeenth day of Augt anno Dom One thousand Seven hundred and thirty Six came hereinto Court as well the afd Robert Hodge as the afd Katherine Stewart in their proper persons according to the Supbena afd and the petition afd being read and heard and the premisses Considered and Mature deliberation thereupon had Whereupon the said Katherine Stewart is ordered to give the said Robert Hodge good and Sufficient security to save and Keep him Indemnifyed as by the petition afd is prayd but the said Katherine Stewart making it appear to the Court here that she is not able to give such security as before directed but that she the said Katherine is willing to Surrender and deliver up unto the said Hodge all the Estate of the said William Stewart that she hath in her hands that doth belong unto the Children of the said William Stewart thereupon the Court do order & appoint Edward Rownd and Wm Gray of Manocan of Somerset County Gent to reappraise the Estate of the said William Stewart in the hands of the afd Katherine Stewart unto the afd Robt Hodge &a but if it should happen hereafter upon the said Robt Hodges making application unto the said Katherine for the said Estate And the said Katherine refuse to deliver the same that then the said Robert Hodge appear before a majestrate and make affidavitt of the said Katherin's Refusall that the said Majestrate upon the request of said Hodge to Issue his warr.t to the Clerk of the County Court thereby directing him to Issue attachmt agt the said Katherine in order to possess the said Hoge with the Estate of the said William Stewart &a |
