257 mentioned he had there ready &a Whereupon the same sheriffe to witt Joseph Macclester Gent at the same day being solemnly Called brings not in the body of the Same Daniel Ringrose according to the return of the Writt afd in the plea afd but makes default &a Therefore at the prayer of the afd Levin Dashiel It is Considered by the Justices here that the afd Sheriffe to witt Joseph Macclester be amercieed to his Lordship the Lord Proprietary for his default afd the sum of four pounds Eight Shillings and four pence halfe paper money 106 as also pounds ^of tobacco^ for Costs and Charges Expended in prosecuting of ^the^ action afd by the Court here adjudged and the afd sher in Mercy &a Thomas Phillips Late of Somerset County planter Came hereinto Court in his proper according to a Certain writt of attachment against him Issued for not appearing at June Court Last he being Legally sumoned thereto for not buring of tobacco according to act of assembly in Such Case provided and forasmuch as the said Thos Phillips hath nothing to Object that was Materiall but was willing to pay his fine for the same Wherefore it is Considered by the Court here that the said Thomas Phillips pay unto his Lordship the Lord Proprietary for his fine for and by occasion of the premisses afd twenty Shillings Current money &a John Evans sen.r Late of Somerset County planter Came hereinto Court in his proper person according to a Certain writt of attachment against him Issued for not appearing at June Court Last he being Legally Sumoned thereto for not bearing of tobacco according to act of assembly in Such Case provided and foras much as the said John Evans hath nothing to Object that was Materiall but was Willing to pay his fine for the same Wherefore it is Considered by the Justices here that the said John Evans pay unto his Lordship the Lord proprietary Six pounds Curr.t money of Maryland ^for his fine^ for and by Occasion of the premisses afd &a Alexander Mitchell Late of Somerset County planter Came hereinto Court in his proper person according to a Certain Writt of attachment against him Issued for not appearing at June Court Last he being Legally Sumoned thereto for not burning of tobacco according to act of assembly in such Case provided and forasmuch as the said Alexander hath nothing to Object that was Materiall but was willing to pay his fine for the same Wherefore it is Considered by the Justices here that the said Alex.d Mitchell pay unto his Lordship the Lord Proprietary twenty Shillings Curr.t money of Maryland ^for his fine^ for and by occasion of the premisses afd &a Forasmuch as the said George Goddard of Someset County planter had not burnt so much tobacco as by Law he was Oblidged to burn but was willing to pay his fine for the same &a Wherefore it is Considered by the Court here that the afd George Goddart pay unto his Lordship the :Lord Proprietary for his fine for and by occasion of the premisses afd four pounds Curr.t money of Maryland &a Forasmuch as a Certain John Mitchell of Somerset County planter and not burnt so much tobacco as by Law he was oblidged to burn but was willing to pay his fine for the same &a wherefore |
