256 near Cottinghams Creek Wee therefore require you or any three or two of you at some time and place as to you or any three or two of you shall seem Convenient you meet on the afd land called Lott (you first having taken your oaths on the holy Evangelist of almighty God according to act of assembly in such case made and approved) and there cause to come before you or any three or two of you all such Eevidences as shall be to you or any three or two of you nominated by the said Complainent or deft if any and that you or any three or two of you Examine them upon their Corporall oaths to be by you or any three or two of you Administred on the holy Evangelist of Almighty God in the presents of the Complainent or deft if any touching the truth or Rememberance of their knowledge or any thing that may relate to the cause afd and that reducing the severall depositions into writing you send the same together with this our Commission under your or any three or two of you hands and seals to us to our County Court of Somerset with all Convenient Speed Wittness Robt King Gent Chief Justice of our said Court the seventeenth day of June in the twenty second year of our dominion &c Anno Dom one thousand seven hundred and thirty six Now hereat this day to witt the Seventeenth day of August Ann Dom One thousand Seven hundred & thirty Six than Came into Court the Severall Commissioners mentioned in the afd Commission and made return thereof Endorsed as followeth with the Severall depositions thereto annexed August the 14.th 1736 then the within Levin Gale Edward Chambers Thomas Gillis and Mathias Gale Qualified themselves to Execute the within Commission by taking the oaths by the act of assembly in that Case made and Provided directed before the Subscriber one of the Justices of the Peace for Somerset County Geo Dashiell The Execution of this Commission appears in a schedule thereto annexed Levin Gale Edward Chambers Thomas Gillis Mathias Gale Somerset County ss Depositions of Wittnesses taken the fourteenth of August seventeen hundred and Thirty Six upon a tract of Land Called Lott lying on the north side of Rockawakin River in Somerset County afd by Virtue of a Commission out of Somerset County Court due notice being ^first^ Given as the act of assembly in that Case made and provided directs Allexander Adams Rector of Stepney parish aged about fifty Six years being sworn on the holy Evangelist of almighty God at request of Mr John Handy deposeth & Saith that the Last Spring was twelve months old Richard Nicholson Late of Somerset County dec.d shewed the deponant a burnt Stump which the deponant verily believes to be a stump where the deponant was this day sworn by the Commissioners appointed to Examine wittnesses in relation to the bound.r of a tract of Land Called Lott and where the said Commissioners Caused a mulbery post marked with Sixteen Notches to be set up which is about thirty three yards from a point in a fork of two Branches a Little above in respect to Rockawakin river a place Called Thomas Humphrys Cellar and about five yards from a Pine marked with four Notches on three sides which stands on the Edge of the Westermost side of the northermost |
