was attached to answer unto Mary Tate Executrix of the testament and Last
Will of Thomas Tate dec.d of a plea of trespass upon the Case &.a
             And whereupon the said Mary by Francis Allen her attorney Complains that Whereas the
said Woney the twenty Eighth day of august anno Dom Seventeen hundred and thirty five at
Somerset County within the Jurisdiction of this Court was Indebted unto the said Thomas in his Life
time in five pounds four shillings Currant money of Maryland as by account hereunto annexed
may in Court appear and being so thereof Indebted the said Woney in Consideration thereof the
day and year aforesaid at the place afd upon himselfe did assume and to the said Thomas in
his Lifetime then and there faithfully did promise that he the said Woney the aforesaid five pounds
four Shillings to the said Thomas when he Should be thereunto requested well and faithfully pay
and Content  Nevertheless the said Woney his promise and assumption afd in form afd made nothing
regarding but plotting and fraudulently intending the said Thomas in his Lifetime and the said
Mary since the decease of the said Thomas in that part Craftilly and Subtilly to deceive and
defraud and as to four pounds fifteen shillings the Ballance due on the said account the
said four pounds fifteen Shillings tho' often requested to the said Thomas in his Lifetime or
to the afd Mary Since ye death of the said Thomas hath not paid but the Same to pay hath
refused and the Same to the said Mary to pay still doth refuse and deny to the damage
of the said Mary of nine pounds Curr.t money of maryland and thereupon she bringeth
suit &.a  and to the retarding her in the Execution of the Last will and testament afd &a  and
she brings into Court her Letters Testamentary by which &.a      pledges &a  John Doe R Roe
march 6th      Woney MccClemmy D.r to the Estate of the Late dec.d   Thomas Tate
