248 Law and that by good and Lawfull men of my ^your^ bailywick you make know unto the person or persons in whose hands you make the same attachment that he she or they be and appear before our Justices of our County Court to be held as afd to Shew Cause if any he she or they have why the same goods Chattells rights or Creditts so attached in his her or their hands ought not to be Condemned and Execution thereof had and made according to act of assembly in such Case made and Provided if to him her or them it shall seem meet and how you shall Execute this writt that you make know unto our said Justices at the day and Place afd and have you then and there this writt Wittness John Smith Gent One of our Justices of our said Court the twentieth day of march anno Dom One thousand Seven hundred and thirty five Att which said third Tuesday of June to witt the Fifteenth day of the Same month anno Dom One thousand Seven hundred and thirty six being the day of the return of the said writt Cometh the said William Macclemmey by his George Douglas his attorney and the sheriffe of Somerset County to witt Joseph Macclester Gent at the Same day Returned to the Justices of his Lordships County Court of Somerset at dividing Creek that he by Virtue of writt afd on the twentieth ^ninth^ day of may Seventeen hundred & thirty Six did attach at the County afd for the Use of William Macclemmey as the rights & Creditts of Thomas Gray in the hands of John Waters the money and tob.o in the writt afd mentioned and by Joshua Merrill & John Doe honest and Lawfull men of my bailywick I did make known unto the said John Waters that he should be and appear at the time & place within Contained as by the within precept I was Commanded &a And the said John Waters by Robert Jenckins Henry his attorney Comes and prays Leave to Imparle hereuntill next Court and he hath it and the Same day is given to the afd Will.m Macclemmey here also &a Att which said next Court to witt the Seventeenth day of August anno Dom one thousand Seven hundred & thirty Six Came againe as well the afd William Macclemmey as the afd John Waters by their attorneys afd and whereupon the said John Waters says that he Cannot Gainsay but that he hath of the rights and Creditts of the said Thomas Grays to the Value of four hundred pounds of tob.o and not more and because the afd William Macclemmey denys not this but the Same allegation Confesseth to be true prays that the same four hundred pounds of tob.o may be Condemned in the hands of the Same John Waters as of the rights and Creditts of the said Thomas Gray and Likewise prays Judgmt for his Costs and Charges by him in yt part |
