247 Thomas here also &a Att which said next Court to witt the Seventeenth day of August anno Dom one thousand Seven hundred and thirty Six Came again as well the afd Thomas Selby as the afd John Bishop by their attorneys afd And whereupon the same John defends the force and Injury when &.a and prays Judgmt of the declaration afd ^because he saith yt the decln afd^ and the matter in the Same Contained are not Sufficient in Law to maintain the action afd of the afd Thomas against him the said John to which declaration the said John hath noe need nor by the Law of the Land is he Obliged in any Sort to answer and this he is ready to Verifie wherefore for want of a sufficient declaration in that part the said John prays Judgm.t of the declaration afd and that the said declaration may be quashed &a And the said Thomas for that he Sufficient Matter in Law in his declaration afd to maintain his action afd against him the said John Bishop hath alledged which matter the said John Bishop hath not gainesayed but the truth thereof to admitt altogether doth deny as before prays Judgment and his debt afd together with his damages for detaining that debt to him to be adjudged Whereupon the said John Bishop by his attorney afd relinquisheth his verification afd by him above alledged says that he Cannot gaine say the action afd of the afd Thomas nor but that the writing Obligatory afd is the deed of the Same John nor but that he Owes the Same Thomas the afd Seventeen pounds in manner and form as the afd Thomas above against him declared wherefore the said Thomas prays Judgmt for his debt afd and his damages sustained by Occasion of the detaining of the same debt to him to be adjudged &a Therefore it is Considered that the afd Thomas Selby recover against the afd John Bishop his debt afd and his damages Sustained by occasion of the detention of the same debt to 390 Four hundred & Twelve pounds of tobacco to the same Thomas of his assent by the Court here adjudged and the afd John Mercy &a
Shall be found in your bailywick to the Value of five pounds four Shillings Curr.t money of Maryland and five hundred pounds of tobacco and when you have the Same attached you have the Same before our Justices of our County Court of Somerset to be held at dividing Creek the third Tuesday of June next then and there to be Condemned according to act of assembly to and for the Use of a Certain William Macclemmey unless the said Thomas Gray by himselfe or his attorney shall appear and answer unto the said William Macclemmey in a plea of trespass upon the Case &.a according to Law |
