                                  Therefore it is Considered by the Justices here that the afd sum of four hundred
pounds of tobacco so as afd Confessed be Condemned in the hands of the said John Waters as of the rights and
Creditts of the said Thomas Gray also it is Considered that the said William Macclemmey recover against
187   the said John Waters                                                                              pounds of tobacco for his
Costs and Charges by him in this part Expended according to act of assembly to him adjudged & that the said
William Macclemmey have thereof Execution &a

                    Charles absolute Lord and Proprietary of the provinces of Maryland
and avalon Lord Baron of Baltemore &a  To the Sheriffe of Somerset County Greeting
we Command you that you attach any the goods Chattells rights or Creditts of Thomas Gray
                                     Late of Somerset County Merchant if they Shall be found in your Bailywick to the Value of seven
pounds seven Shillings and Eleven pence Curr.t money of Maryland and thirteen hundred pounds of tobacco &
when you have the Same attached or any part thereof the same in your Custody safe keep so that you have the
Same before our Justices of Our County Court of Somerset to be held at dividing Creek the third Tuesday of
June next then and there to be Condemned according to act of assembly to and for the use of a Certain William
Macclemmey unless the said Thomas Gray by himselfe or his attorney shall appear and answer unto the
said William Macclemmey in a plea of trespass upon the Case &.a according to Law and that by good and
Lawfull men of your Bailywick you make known unto the person or persons in whose hands you
make the same attachment that he she or they be and appear before our Justices of our County Court to be
held as afd to Shew Cause if any he Shee or they have why the Same goods Chattells rights or Creditts
so attached in his her or their hands ought not to be Condemned and Execution thereof had and made according
to act of assembly in such Case made and provided if to him her or them it shall seem meet and how you
shall Execute this writt that you make known unto Our said Justices at the day and place afd and
have you then and there this writt  Wittness John Smith Gent One of our Justices of Our said Court
the twentieth day of March anno Dom One thousand seven hundred & thirty five

    Att which said Third Tuesday of June to witt the fifteenth day of the same month anno Dom One thousand
seven hundred & thirty Six being the day of the return of the Same Writt Came the said William McClemmey
by ^George Douglas^ his attorney afd and the Sheriffe of Somerset County to witt Joseph Macclester Gent at the same
day returned to the Justices of his Lordships County Court of Somerset at dividing Creek that by Virtue
of the Writt afd that he on the twenty Eighth of may seventeen hundred & thirty Six did attach for the
use of the said William McClemmey of the rights and Creditts of the said Thomas Gray in the hands of Richard
Phillips the money and tobacco in the writt afd mentioned and by John Doe & Richd Roe good & Lawfull
men of his bailywick he did make known unto the said Richard Philips that he Should be & appear at the time
