247 obligatory which the said Thomas sealed with the seal of the said John hereinto Court brings whose date is the day and year afd did promise to pay to the said Thomas Selby the sum of seventeen pounds in corn pork and tobacco at the prices following Corn at Twenty pence pork at twelve and six pence p hundred and tobacco at the market price on or before the first day of January then next ensuing And the afd Thomas in fact says that on the said first day of Janu^a^ry afd next ensuing the date of the said writing at the County afd he the said Thomas did request the said John to pay to the said Thomas the said seventeen pounds in the species afd and the said Thomas farther in fact says that he the said John did not then and there pay to the said Thomas the said seventeen pounds in the species afd by which action hath accrued to the said Thomas to require and have of the said John the said seventeen pounds Nevertheless the said John the said seventeen pounds to the said Thomas hath not rendered but the same to him to render hitherto hath denyed & still doth deny and unjustly detain altho often thereto since the said first day of Janry by the said Thomas required whereupon the said Thomas saith that he is damnified twenty pounds Currant money of Maryland and thereof he brings suit &a pledgs &a Jno Do R Roe Whereupon a Certain Duncan Murray of Somerset County Marriner Came hereinto Court in his proper person and undertook for the said John Bishop and assumed upon himselfe (Likewise the same John Bishop present herein Court assumed upon himselfe) that if in Case the Said Thomas Selby should recover Judgment in the plea afd against the said John Bishop or that the said John Bishop should be therein Convicted that then he the said John Bishop should pay the Judgment of the Court thereupon or render his body in Execution of Such Judgment to the prison of the Sheriffe of Somerset County in Satisfaction thereof or that he the said Duncan Murray will do the Same for him &a And the aforesaid John Bishop by Francis Allen his attorney Cometh and Saving to himselfe all advantages as well to the writt as to the Narration afd prays Leave thereof to Imparle hereuntill next Court and he hath it and the Same day is given to the afd Thomas Selby here also &a Att which said next Court to witt the fifteenth day of June anno Dom One thousand Seven hundred and thirty Six Came again as well the afd Thomas Selby as the afd John Bishop by their attorneys afd And whereupon the Same John Bishop prays further Leave thereof to Imparle hereuntill next Court and he hath it and the Same day is given unto afd Thomas |
