the force and Injury when &.a and says that he did not assume upon himselfe in such manner and form as
the said ^James^ and William above against him have Complained and of this he putts himselfe upon the Country
and the Plfts Likewise
                                                                               Thereupon it is Commanded the Sheriffe of Somerset County
that Immediately he should Cause to Come here before the Justices of his Lordships County Court of somerset
now here sitting at dividing Creek in the Same County twelve &.a by whom &.a and who neither &.a to recognize
&.a because as well &.a and afterwards Immediately Came thereof the Jury &.a and the Jurors of
that Same Jury by Joseph Macclester Gent sheriffe of the County afd to this Impannelled being Called
Came to witt Thomas Dixon John Atkinson George Tull Joseph Gray William Mills Geo: Howard
Joseph Hall John Jones Robert Givan John Webb John Davis and Alexander Lankey who to say
the truth of the premisses afd being duely Elected tryed and sworn and were from the Barr of this Court
of their Verdict of and upon the premisses ^afd^ to render and among themselves to Commune did recede
and afterwards to the same barr for their Verdict in that part to render came upon that the afd
Daniel & ^William^ altho' Solemnly Called Cometh ^not^ nor further prosecutes the writt and declaration afd against
the afd Daniel           
                                                   Therefore it is Considered by the Court here that the afd Daniel
Quatermus and William Robinson take nothing by their Writt and declaration afd but ^that^ they &
their pledges of prosecuting to witt John Doe & Richard Roe are in mercy and that the afd Daniel
Kinnigan goe thereof without day &.a and further it is Considered that the afd Daniel Kinnigan
455    recover against the afd James and William
pounds of tobacco for his Costs and Charges by him about his defence in that part Sustained to the same
Daniel by the Court here according to the form of the Statute in such Case thereof Lately made & provided
adjudged and that the same deft have thereof Execution &a

Called John Bishop Junr was Summoned to answer to Thomas Selby
of a plea that he render him seventeen pounds in the following
    Commodites Viz.t Corn pork and tobacco at the following prices Corn at Twenty pence
    pork at twelve and six pence p hundred and tobacco at Markett price which to him
    he oweth and unjustly detaineth &c

    And Whereupon the said Thomas by Geo: Douglas his attorney says that
    whereas the said John on the seventh day of August Anno Dom seventeen hundred and
    thirty three at somerset County afd within the Jur of this Court by his certain writing
                                                                                                                   (obligatory)
