and request of the afd Daniel and for the proper debt of the same Daniel did pay and satisfie
unto a Certian Joseph Macclester eighteen hundred and twenty pounds of tobacco which from
the same Daniel to the afd Joseph Macclester before that same day was due and owing
in Consideration whereof the same Daniel on the same day and year above said and within the
parish County and Jurisdiction afd upon himself assumed and to the same James and William
then and there did faithfully promise to pay to the same James and William the same eighteen
hundred and twenty pounds of tobacco when thereof afterwards he should be thereunto required
Notwithstanding the afd Daniel his promise and assumption afd made Little regarding
but plotting and fraudulently Intending the same James and William in that part Craftily
and Subtilly to deceive and defraud the same eighteen hundred and twenty pounds of tobacco
to the same James and William [according to his promise and assumption afd in form afd
made] hath not paid altho' to this to doe the same Daniel on the second day of July
anno Dom one thousand seven hundred and thirty five and often afterwards at the
County afd by the same James and William was required but the same Daniel to
them hitherto to pay or Content altogether denyeth and refuseth and as yett doth deny and
refuseth to the damage of the same James and William three thousand six hundred and
forty pounds of tobacco and thereof they bring suit &c         Pledges &c   John Doe & R Roe

       And the said Daniel Kinnigan by George Douglas his attorney Comes and defends
the force and Injury when &a and prays Leave thereof to Imparle hereuntill next Court
Court and he hath it and the same day is given to the afd James and WIlliam here also &.a

    Att which said next Court to witt the sixteenth day of March anno Dom One thousand
seven hundred and thirty five Came againe as well the afd James and William by their attorney
afd as the afd Daniel by his attorney afd and whereupon the same Daniel prays further
Leave thereof to Imparle ^hereuntill next Court^ and he hath it and the Same day is given to the afd James &
William here also &a

          Att which said next Court to witt the fifteenth day of June anno Dom One thousand seven
hundred and thirty Six Came againe as well the afd James and William by their attorney afd as the
afd Daniel Kinnigan by his attorney afd and whereupon the same Daniel prays further Leave
thereof to Imparle here untill next Court and he hath it and the Same day is given to the afd
James and William here also &a

          Att which said next Court to witt the seventeenth day of august anno Dom one thousand
seven hundred and thirty six Came againe ^as well^ the afd James and William by their attorney afd
as the afd Daniel by his attorney afd and whereupon the same Daniel as before defends
