244 Att which said next Court to witt the seventeenth day of august ann Dom one thousand seven hundred and thirty six came again as well the afd John Fallows as the afd Thomas Fletcher by their attorneys afd And whereupon the same Thomas Fletcher as before defends the force and Injury when &a and says that he did not assume upon himselfe in such manner and form as the afd John above against him doth Complain and of this he puts himselfe upon the Country and the said John Likewise Thereupon it is Commanded the Sheriffe of Somerset County that Immediately he should cause to Come here before the Justices of his Lordships County Court of Somerset now sitting at dividing Creek in the Same County twelve &a by whom &a and who neither &a to recognize &a because as well &a And afterwards Immediately Came thereof the Jury &a and the Jurors of that same Jury by Joseph Macclester Gent sherriffe of the County afd to this Impannelled being Called Came to witt Thomas Dixon John Atkinson George Tull, Joseph Gray William Mills, George Howard Joseph Hall, John Jones Robert Givan John Webb John Davis Adam Spence who to say the truth of the premisses afd being duely Elected tryed and Sworn upon their Oath do say that the afd Thomas Fletcher did assume upon himselfe in such manner and form as the afd John Follows above against him hath Complained and assessed the damages of the Same John Fallows by occasion of the non performance of the promise and assumption afd beyond his Costs and Charges by him about his Suit in that part apposed to Eight hundred pounds of tobacco and for those Costs and Charges to One pound of tobacco Therefore it is Considered that the afd John Follows recover against the afd Thomas Fletcher his damages afd by the Jurors afd in form afd assessed as also 1234 pounds of tobacco for his Costs and Charges afd to the Same John Fallows by the Court hereof his assent of Increase adjudged which Certain Damages in the whole doe amount to pounds of tob.o & the afd Thos in mercy &.a
convenient in somerset which to him he oweth and unjustly detaineth &c And Whereupon the said Thomas by Geo: Douglas his attorney says that whereas the (aforesaid) |
