244 aforesaid Richard on the twenty fourth day of august Anno Dom seventeen hundred ^and^ Nineteen at somerset County afd by his certain writing obligatory which the said Thomas sealed with the seal of the said Richard here into Court brings whose date is the day and year afd did acknowledge himself to owe to the afd Thomas Dashiel the afd sum of ten thousand pounds of good sound Marchantable tobacco and caske Convenient in Somerset to be paid to the said Thomas Dashiel his Executors admrs or assignes when he the said Richard should be afterwards thereto required and to the faithfull payment of the afd sum the said Richard did bind himself his heirs Executors and administrators by the said writing obligatory Nevertheless the afd Richard the afd ten thousand pounds of good sound Merchantable tobacco and cask to the said Thomas hath not rendered but the same to him hitherto to render hath denyed and the same to him to render still doth deny and unjustly detain altho' the same to doe afterwards to wit the first day January Anno Dom seventeen hundred and thirty three at somerset County afd and often since that time the said Richard by the said Thomas was required Whereupon the said Richard says he is the worse and hath to the value of twelve thousand pounds of tobacco and thereof he brings suit &c pledges &c John Doe R Roe And the aforesaid Richard Holland by Francis Allen his attorney Cometh and defendeth the force and Injury when &.a and prays Leave thereof to Imparle here untill next Court and he hath it and the same day is given to the ^afd^ plantiffe here also &a Att which said next Court to witt the Eighteenth day of November ann.o Dom One thousand seven hundred and thirty five Came againe as well the afd Thomas Dashiell as the afd Richard Holland by their attorneys afd and whereupon the said Richard Holland prays further Leave thereof to Imparle here untill next Court and he hath it and the Same day is given to the afd Thomas here also &a Att which said next Court to witt the sixteenth day of March anno Dom One thousand Seven hundred and thirty Five Came againe as well the afd Thomas Dashiell as the afd Richard Holland by their attrnys afd and whereupon the said Richard Holland prays further Leave thereof to Imparle hereuntill next Court and he hath it and the Same day is given to the afd Thomas here also &a Att which said next Court to witt the fifteenth day of June ann Dom One thousand seven hundred and thirty Six Came againe as well the afd Thomas Dashiell as the afd Richard Holland by their attorneys afd and whereupon the said Richard Holland prays further Leave thereof to Imparle here untill next court and he hath it and the Same day is given to the afd Thomas here also &a Att which said next Court to witt the Seventeenth day of August anno Dom One thousand Seven hundred and thirty Six Came againe as well the afd Thomas Dashiell as the afd Richard Holland by their attorneys afd and whereupon the said Richard as before defends the force and Injury when &a and prayeth the hearing of the writing obligatory afd and it is read unto him in these words following viz.t Know all men by these presents that I Richard Holland of the County of Somerset and province of |
