243 to implead the said John Magan for the said debt of eight hundred pounds of tobacco on Consideration that he the said John Fallows at the especiall request and Instance of the said Thomas Fletcher did then and there promise totally to forbear to implead the said John Magan for the said eight hundred pounds of tobacco he the said Thomas upon himself did assume and to the said John Fallows then and there faithfully promise that he the said Thomas would pay to the said Fallows the quantity of eight hundred pounds of tobacco when he should afterward be thereto required And Whereas the said John Fallows afterwards to witt the day and year afd at the County afd at the especiall request and Instance of the said Thomas Fletcher did pay to the said John Magan the further quantity of eight hundred pounds of tobacco he the said Thomas on Consideration thereof upon himself did assume and to the said John Fallows then and there faithfully promise that he the said Thomas Fletcher the eight hundred pounds of tobacco last mentioned to the said John Fallows when afterwards he should be thereunto required to the said Fallows would faithfully pay and Content Nevertheless the said Thomas Fletcher his severall promises and assumptions afd in form afd made nothing regarding but minding and fraudulently intending the said John Fallows in that part craftily and subtily to deceive and defraud the said severall sums of tobacco or any prat thereof the said John Fallows hitherto hath not paid or him for the same in any sort contented but the same ot him to pay hitherto hath refused and still doth refuse altho' the same to doe afterwards to witt on the first day of april Anno Dom seventeen hundred and thirty five at the County afd and often since that time the said Thomas by the said John Fallows was required Whereupon the said John Fallows says he is damnify'd sixteen hundred pounds of tobacco and thereof he brings suit &c Pledges &a John Doe & Richd Roe And the afd Thomas Fletcher by William Goldsborough his attorney Comes and defends the force and Injury when &.c and prays Leave thereof to Imparle here untill next Court and he hath it and the same day is given to the afd John Follows here also &a Att which said next Court to witt the Eighteenth day of Novem anno Dom one thousand Seven hundred and thirty five Came againe as well the afd John Fallows as the afd Thomas Fletcher by their attorneys afd And whereupon the said Thomas Fletcher prays further Leave thereof to Imparle hereuntill next Court and he hath it and the Same day is given to the afd John Fallows here also &a Att which said next Court to witt the Sixteenth day of March ann Dom one thousand seven hundred and Thirty Five Came againe as well the afd John Fallows as the afd Thomas Fletcher by their attorney afd and whereupon the said Thomas Fletcher prays Further Leave ^thereof^ to Imparle hereuntill next Court and he hath it and the Same day is given to the afd John Fallows here also &a Att which said next Court to witt the fifteenth day of June anno Dom One thousand seven hundred and thirty Six Came againe as well the afd John Fallows as the afd Thomas Fletcher by their attorneys afd And whereupon the same Thomas Fletcher prays further Leave thereof to Imparle here untill next Court and he hath it and the Same day is given to the afd John Fallows here also &a Att |
