Att which said Third Tuesday of August to witt the Seventeenth day of the Same month
Ann.o Dom One thousand seven hundred and thirty Six being the day of the return of the
same writt Came the said Levin Gale by his attorney afd and the sheriffe of Somerset County
to witt Joseph Macclester Gent Likewise Cometh and returned that by vertue of the Writt of
the writt afd to him thereof directed he had taken the body of the afd William Wye whose body
before ^his Lordships^ the Justices at the same day and place in the writt afd Mentioned he had there ready &a and
Likewise that he had Served the Same William Wye with a Copy of the Narration afd according to
act of assembly in such Case provided &c

    And the afd William Wye in his Own proper person Cometh and defendeth the force &
Injury when &a and Saith and saith that he Cannot gainsay the action afd of the afd Levin
nor but that he did assume upon himselfe in manner and form as the afd Levin above
against him hath Complained and as to the damage of the Same Levin by him by occasion
of the premisses in that part Sustained the same William Saith and Confesseth that the
afd Levin has Sustained damages by Occasion of the premisses beyound his Costs and Charges
by him about his Suit in that part apposed to Sixty four pounds thirteen Shillings and
Eight pence Curr.t money of Maryland and not more and because the afd Levin denys not
this but the Same allegation Confesseth to be true prays Judgm.t for those damages first above
Confessed together with his Costs and Charges afd to him to be adjudged &a

          Therefore by Consent of the parties afd it is Considered by the Court here that the afd Levin
Gale recover against the afd William Wye his damages afd to the afd Sixty four pounds thirteen
shillings and Eight pence Curr.t money of maryland by the Same William in form afd Confessed
427   as also Four hundred and Twenty                              pounds of tobacco for his Costs and
Charges afd to the same Levin at his request by the Court here by Consent of the parties afd
adjudged and the afd deft in mercy &a

attached to answer Jo John Fallows of a plea of trespass upon the Case &a
And whereupon the said John by George Douglas his attorney Complaines
    whereas a Certain John Magan on the tenth day of April Anno Dom seventeen hundred and thirty
    four at the County afd was Indebted the said John Fallows in the quantity of eight hundred
    pounds of tobacco and the said John Fallows ^on^ the day and year afd at the County afd intended
