241 Otherwise Called John Donaldson of Somerset County and Province afd if he should be found in his bailywick and him should safe keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of August then next to answer unto James and Adam Muirs of the same province Merch.ts of a plea that he render unto them three hundred and Eighty Four pounds Eleven pence halfe penny Currant money of Maryland which to them he owes and Unjustly detaines &.a and that thereof he Should not fail &c And the said James and Adam Muir by Robert Jenckins Henry their attorney declared ag.t the said John Donaldson in the plea afd as followeth viz.t Somerset ss John Donaldson late of Somerset County Gentleman Otherwise Called John Donaldson of Somerset County in the province of Maryland was sumoned to answer unto James and Adam Muirs of the same Province Merch.ts of a plea that he render unto their three hundred and Eighty four pounds Eleven pence halfe penny Curr.t money of Maryland which to them he Owes and Unjustly detaines &a And whereupon the same James and Adam by Robert Jenckins Henry their attorney say that whereas the afd John the Eighteenth day of October in the Year of our Lord of One thousand seven hundred and Twenty Eight at Somerset County afd within the Jurisdiction of this Court by his Certain writing Obligatory did acknowledge himselfe to be held and firmly bound unto the afd James and Adam in the afd three hundred and Eighty Four pounds Eleven pence halfe penny Currant money afd to be paid to the Same James and Adam when he should be thereunto requested Nevertheless the said John altho' often thereunto requested the afd three hundred & Eighty Four pounds Eleven pence halfe penny to the Same James and Adam or either of them he hath not as yett rendered but the Same to them or Either of them to Render hath denyed and still doth deny and refuse wherefore they Say that they are the worse and have damage to the value of fifty pounds Curr.t money of the province afd and thereof they bring Suit &a and bring hereinto Court the writing afd which the debt afd in form afd doth Testifie the date whereof is the same day and Year afd P Quer pledgs &a John Doe R Roe A Copy of the foregoeing declaration was made and Sent to be served on the deft according to act of assembly &a Att which said Third tuesday of August to witt the Seventeenth day of the Same month anno Dom One thousand Seven hundred and thirty Six being the day of the return of the said Writt Came the said James and Adam Muirs by their attorney afd and the Sheriffe of Somerset County |
