1736 241 and faithfully promised that he the said James Dickerson would well and truely Content and pay to the said Andrew the said quantity of twelve hundred and Eighty Eight pounds and a halfe of tobacco in Cask when after he Should be thereto required Nevertheless the said James his promise and assumption afd so as afd made noe ways Regarding but designing and fraudulently Intending him the said Andrew in this part Craftilly to deceive and defraud the said Twelve hundred and Eighty Eight and a halfe pounds of tobacco to the said Andrew altho' often thereto required to witt the day and year abovesaid at the County of Somerset afd by the said Andrew hath hath not paid but the Same to pay hath hitherto refused and still doth refuse to the plfts damage Twenty pounds and thence he sues &c Pledgs deft Jno Doe R Roe And the afd James Dickerson by Francis Allen his attorney Cometh and defendeth the force and Injury when &a and says that he Cannot Gainsay the action afd of the afd Andrew Anderson nor but that he did assume upon himselfe in manner and form as the afd Andrew above against him hath Complained And as to the damage of the said Andrew by him by Occasion of the premisses in that part Sustained the same James saith and confesseth that the afd Andrew has sustained damages by Occasion of the premisses beyond his Costs and Charges by him about his suit in that part apposed to Twelve hundred and Eighty Eight and a halfe pounds of tobacco and not more and because the afd Andrew deny's not this but the allegation Confesseth to be true prays Judgm.t and those damages above acknowledged together with his Costs and Charges afd to him to be adjudged &a Therefore by Consent of the parties afd It is Considered that the afd And.w Anderson Recover against the afd James Dickerson his damages afd to the afd Twelve hundred and Eighty Eight and a halfe pounds of tobacco by the Same James in form afd Confessed as also three hundred & fifty pounds of tobacco for his Costs & Charges afd to the same Andrew by the Court here by Consent of the parties afd adjudged &a and ye afd deft in mercy &a wth stay Exn till tenth Fery next
