23 pounds sterling good and Lawfull money of England of his goods and Chattells Lands and tenements to the use of his said Lordship his heirs and Successors ^to be made and levied^ if it Happen that the said Daniel Jones do not make his personall appearance before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of august next and do not then and there give Such Evidence as he shall know against a Certain John Roberts for Concealing a taxable and do depart the Court without Leave &a
within the Jurisdiction of this Court one Canoe of the Value of one Hundred pounds of Tobacco of the Goods and Chattles of Henry Walter then and there being found then and there feloniously did steal take and Carry away contrary to the Peace of the said Lord Proprietary that now is his Good Rule and Government and against the Form of the act of Assembly in such Case lately made and provided &ca Testes Henry Walter John Pullett, Majr Floyd George Tull John Bradley Charles Dashiell Richard Hooffington On the backside of the foregoing Bill of Indictment it was thus Endorsed vizt True Bill p Josa Caldwell foreman Afterwards to witt the Seventeenth day of June anno Dom One thousand seven hundred and thirty five before the Justices of his Lordships County Court of Somerset now here held at dividing Creek in and for the Same County Came the aforesaid John Shiles in his proper person according to a Certain Recognizance by him and his security before acknowledged and being by the Sheriff of the County aforesaid sett to the Barr had a hearing of the Indictment afd who says that he is not guilty thereof and of this he putts himselfe upon the Country and William Goldsborough Gent his said Lordships attorney and who for his said Lordship in that part followeth Likewise Thereupon it is Commanded the Sheriffe of Somerset County that Immediately he should Cause to Came here before the afd Justices twelve &a by whom &a and who neither &a to recognize &a because as well &a and afterwards Immediately Came thereof the Jury &a and the Jurors of that Same Jury by Joseph McClester Gent sheriff of the County aforesaid to this Impannelled being Called Came to witt Day Scott, John Waters Thomas Waller Angello Atkinson Jon.a Sturges George Benston James Breman William Mills Richard Chambers, James Neirne, John Lane and Aaron Lynn who to say the truth of and upon the premisses being Elected tryed and Sworn upon their Oath did Say that the afd John Shiles is not Guilty of the Felony |
