239 he render unto him fifty pounds Curr.t ^lawfull^ money of Pensillvania which to him he owes & unjustly detaines &a And whereupon the said Thomas by Francis Allen his attorney saith that whereas the said William the seventh day of Janry Anno Dom seventeen hundred and thirty four five at the County of Somerset afd within the Jur of this Court by his certain Writing Obligatory which the said Thomas with the seal of the said William signed here into Court brings the date whereof is the same day and year did Accknowledge himself to be bound unto the said Thomas in the afd fifty pounds currt Lawfull money of Pensillvania to be paid unto the said Thomas when he should be thereunto requested Yett the said William tho' often required the said Fifty pounds to the said Thomas hath not rendered but the same to him hitherto to render hath denied and still doth deny and unjustly detain Whereupon the said Thomas saith he is worse and hath damage to the value of twenty pounds Currant money of Maryland and thereupon he brings suit &c Pledges &c John Doe R Roe A Copy of the foregoing declaration was made and Sent to be Served on the defend.t with the writt according to act of assembly in Such Case made and Provided Att which said Third Tuesday of August to witt the Seventeenth day of the Same month anno Dom one thousand Seven hundred and thirty Six being the day of the Return of the said Writt Came the said Thomas Adams by his attorney afd and the Sheriff of Somerset County to witt Joseph MccClester Gent at the Same day and place in the writt afd within Mentioned Returned that the Same William Burton is not found &a Whereupon the said Thomas Adams by his attorney afd prays that forasmuch as he has Complyed with the Law in Order to an attachment he may have Judgment against the said William Burton for his debt afd by way of attachment according to act of assembly &a whereupon for that it seems to the Court here that the said Thomas Adams hath Complyed with the Law as alledged Therefore it is Considered by the Court here that the afd Thomas Adams Recover against the afd William Burton Fifty pounds Curr.t Lawfull money ^of Pensilvania^ his debt afd as also all his damages Costs and Charges 431 by the said Plft Laid Out and Expended about his Suit by way of attachment against the goods Chattells rights or Creditts of the said WIlliam Burton according to act of assembly in such Case made and provided &a
