1736 239 whereupon the said Listian he is worse and hath damage to the value of nine thousand pounds of tobacco and thereof he brings his Suit and the said Listian Alexander hereinto Court brings the testamentary Letters of the afd William Alexander by which it sufficiently appears to the Court here that the said Listian Alexander is Executor of the testament and Last Will of the said William Alexander and thereof to have administration Pledges &a Jno Doe R Roe Att which said third Tuesday of august to witt the seventeenth day of the same month anno Dom One thousand Seven hundred and thirty Six being the day of the return of the Same Writt Came the said Listian Alexander by his attorney afd and the Sheriffe of Somerset County to witt Joseph MccClester Gent ^Likewise Cometh &^ returned that by vertue of the Writt afd to him directed he had taken the body of the afd Renshar Roberts whose body before his Lordships Justices at the same day and place in the writt afd mentioned he had there ready &a And the afd Listian Alexander who ofered his writt & declaration afd in the afd Plea of Debt of Eight thousand pounds of tob.o against the afd Renshar Roberts appears by pretext of his Lordship writt afd at Suit of the Same Listian Alexander which same Writt and declaration the same Listian against the afd Renshar ^afterwards^ did not prosecute Therefore it is Considered by the Justices here that the afd Listian Alexander ^Executor of ye same Wm Alexd^ take nothing by his writt and declaration afd but that he and his pledges of prosecuting to witt John Doe and Richard Roe are in mercy and that the afd Renshar go thereof without day &a
if he shold be found in his bailywick and him should safe keep so that he might have his body before the Justices of his Lordship County Court of Somerset to be held at dividing Creek in the Same County the third Tuesday of August then next to answer unto Thomas Adams of a plea that he render unto him ^fifty pounds^ Curr.t Lawfull money of Pensilvania which to him he owes and unjustly detaines &a and that thereof he should not fail &a And the said Thomas Adams by Francis Allen his attorney declared against the said William Burton in the plea afd as Followeth vizt Somerset ss William Burton Late of Somerset County planter al.s dict William Burton of the County of Sussex one delaware Yeoman was sumoned to answer unto Thomas Adams of a plea that he |
