if he should be found in his bailywick and him should safe keep so that he might have his body
before the Justices of his Lordships County Court of somerset to be held at dividing Creek in the
same County the third tuesday of August then next to answer unto Levin Gale Esq.r George
Gale, John Gale and Mathias Gale Gent assignees according to the form of the act of the act of
assembly in such Case provided of John Stewart Sen.r of a plea that he render unto them Sixty
pounds Curr.t money which from them he unjustly detaines &a and that thereof he Should not
fail &c
                         And the afd Plfts declared against the same deft in the plea afd as followeth
vizt Somerset ss.t  Stephen Horsey Late of Somerset County planter administrator of all &
Singular the goods and Chattells rights and Creditts which were of Burr Outerbridge Late of
somerset County marriner dec.d Otherwise Lately Called Burr Outerbridge of Somerset County
in Maryland at the time of his death who died Intestate as 'tis said was Sumoned to answer
to Levin Gale Esq.r George Gale John Gale and Mathias Gale Gent assignees according to
the form of the act of assembly in such Case provided of John Stewart Sen.r of a plea that he
Render unto them sixty pounds Curr.t money which from them he unjustly detaines &a

         And whereupon the afd Levin George John Gale and Mathias by Geo Douglas their attrny
say that whereas the said Burr in his Life time to witt on the twenty fourth day of May
anno Dom Seventeen hundred and thirty two at Somerset County afd within the Jurisdiction
of this Court by his Certain Writing Obligatory which the said Levin George John Gale and Mathias
sealled with the Seal of the said Burr herein Court produced whose date is the Same day and year
afd did acknowledge himselfe to be held and firmly bound unto the said John Stewart sen.r in the
said Sum of Sixty pounds Curr.t money of Maryland to be paid unto the said John Stewart his
heirs Executors adm.rs or assignes when he Should afterwards be thereunto required and whereas
afterwards the afd John Stewart afterwards to witt on the thirty first day of July in the
Year afd (the afd sixty pounds Currant being then due and unpaid) by his Certain Writing of
Assignment on the afd Writing Obligatory indorsed which said Writing of assignment bearing
date the day and year Last mentioned the afd Levin George John Gale and Mathias Gale here
in Court produced did assign to the said Levin ^Gale^ George Gale, John Gale and Mathias Gale the
afd writing Obligatory for value of them rec.d of which the afd Burr Outerbridge afterwards
to witt the day and year Last mentioned had notice at Somerset County afd had notice by
means whereof and by force of the Statute in that Case made and provided action did accrew
