237 the same in your Custody safe keep so that you have the same before our Justices of our County Court of Somerset to be held at dividing Creek the third tuesday of August Next then and there to be Condemned According to Act of Assembly to and for the use of a certian William McClemmey Valess the said Thomas Gray by himself or his attorney shall appear and answer unto the said William McClemmey in a plea of trespass upon the case &c According to law and that by good and lawfull men of your Bailywick you make known unto the person or persons in whose hands you Make the same Attachment that he she or they ^be and appear before our Justices of our County Court to be held as afd to Shew Cause if any he she or they^ have why the same goods chattles rights or Creditts so attached in his or their hands ought not to be Condemned and Execution thereof had and made According to Act of Assembly in such case made and provided if to him her or them it shall seem meet and how you shall Execute this Writt that you Make known unto our said Justices at the day and place afd and have you then and there this Writt Wittness Robert King Gent chief Justice of our said Court the Nineteenth day of June in the twenty second Year of our dominion &c Anno Dom one thousand seven hundred and thirty six Att which said Third Tuesday of August to witt the Seventeenth day of the Same month anno Dom One thousand Seven hundred thirty Six being the day of the return of the said Writt Came the said William Macclemmey by George Douglas his attorney and the sheriffe of Somerset County to whom the foregoing writt was directed Likewise Cometh & maketh return thereof to the Court here Endorsed viz.t By Vertue of the within Writt to me directed to the Justices within Mentioned I do Certifie that on the Eighteenth day of July Seventeen hundred and thirty Six I did attach as the goods and Chattells of the Within Named Thomas Gray in the hands of William Macclemey John Evans Sen.r and Thomas Shiles morenor to the Value of seven pounds Seven Shillings and Eleven pence Curr.t money of maryland and thirteen hundred pounds of tobacco Each and by Christopher Piper and John Doe honest and Lawfull men of my Bailywick I have made known unto the said William MccClemmey John Evans & Thomas Shiles that they be and appear before the Justices of Somerset County Court at the time and place within Contained to shew Cause if any &.a as by the within Writt I am Commanded so answers Jos Macclester sher Whereupon Came hereinto Court the afd William Macclemey in his proper person and says that he Cannot Gainsay but that he hath of the Rights and Creditts of the Same Thomas Gray in his hands to the Value of three pounds Curr.t money and prays that the Same three pounds Curr.t money |
