237 money may be Condemned in his hands as of the Rights & Creditts of the same Thomas Gray towards satisfying unto him his damages & Costs &a Therefore it is Considered by the Justices here that the afd sum of three pounds Curr.t money of Maryland so as afd Confessed be Condemned in the hands of the said William Macclemmey as of the rights and Creditts of the said Thomas Gray towards Satisfying unto the said William Macclemey as well his damages as also all the Costs accrewing upon the writt of attachment afd &c John Evans Gar as aforesaid appears & Imparles &c Thos Shiles discharged &a
answer unto William Draper of a plea of trespass upon the Case &.a and that thereof he should not fail &a Att which said Third Tuesday of June to witt the fifteenth day of the Same month ann Dom One thousand Seven hundred and thirty Six being the day of the Return of the Said Writt Came the Said William Draper by Robt Jenckins Henry his attorney and the Sheriff of Somerset County to witt Joseph MccClester Gent at the Same day returned that the Same John Ciley is not found &.a Thereupon Command is againe Given to the sher of Somerset County that he Should take the Said John Ciley if &.a so that he might have his body before the Justices of his Lordships County Court to be held at dividing Creek in the Same County the third Tuesday day of August then next to answer unto the afd William Draper of the afd Plea and that thereof he should not fail &a Att which said third Tuesday of August to witt the seventh day of the Same month anno Dom One thousand Seven hundred and thirty Six being the say of the return of the same writt Came the Said William Draper by his attorney afd and the sheriff of Somerset County to witt Jos Maclester Gent at the Same day returned that the afd John Ciley is not found &a Thereupon the said William Draper by his attorney afd Complained against the said John Ciley in the plea afd as followeth viz.t Somerset County ss John Ciley late of Somerset County planter was attached to answer unto William Draper of a plea of trespass upon the case &c And Whereupon the same William by Robert Jenckins Henry his attorney complains that whereas the afd John after the first day of May Anno Dom seventeen hundred and five (to witt) the seventh day of June one thousand seven hundred thirty and five at Somerset County within the Jurisdiction of this Court made his certian note in writing commonly called a Promissory note with his own proper hand thereunto subscribed bearing date the same day and year last (mentioned) |
