236 Whereupon the Court here at the prayer of the afd Robert King by his attorney ^afd^ valued Every Twelve shillings and Six pence of the sumes afd Confessed by the afd Esther Tull and Martin Fenton to be of Equall Value with one hundred pounds of tobacco &a Whereupon the said Robert King by his attorney afd prays that upon giveing Security according to act of assembly in Such Case made and provided that the Sums afd so as afd Confessed by the afd Esther Tull and Martin Fenton as of the rights and Creditts of the said Thomas Gray may be Condemned in the hands of the said Esther Tull and Martin Fenton towards Satisfying unto the said Robert King his Costs and Charges accrewed by means of the attachment afd &a Thereupon a Certain Robert Jenckins Henry of Somerset County planter Gent Present here in Court undertakes for the said Robert King according to act of assembly that in Case the said Thomas Gray do at any time within a year and a day appear and make all or any part of the Same Robert Kings Claim against him appear to be satisfied or otherwise to have Been undue before the Laying of this attachment that then the said Robert King shall make restitution unto him the said Thomas Gray of all or such part thereof as shall be made appear to be undue &.a or that he the said Robert Jenckins Henry will do the Same for him &a Therefore it is Considered by the Court here that the afd Sum of thirteen shillings and Eight pence Curr.t money part of the Sum so as afd attached and Confessed be Condemned in the hands of the said Esther Tull as of the rights and Creditts of the said Thomas Gray towards Satisfying unto the Said Robert King his Costs and Charges accrewing by Occasion of the attachment afd and that he have thereof Execution against the said Esther Tull according to act of assembly &a Costs 432 Therefore it is Considered by the Court here that the Sum of Two pounds and four pence Curr.t money of Maryland part of the Sum afd Confessed be Condemned in the hands of the said Martin Fenton as of the Rights and Creditts of the said Thomas Gray towards Satisfying unto the said Robert King his Costs and Charges accrewing by occasion of the attachment afd and that he have thereof Execution against the said Martin Fenton according to act of assembly &a
Somerset County Greeting we Command you that you attach any the goods Chattells rights or Creditts of Thomas Gray late of Somerset County Mercht if they shall be found in your Bailywick to the value of seven pounds seven shillings and eleven pence Curt money and thirteen hundred pounds of tobacco and when you have the same attached or any part thereof (the) |
