236 Value of five hundred pounds of tobacco And when you have the same attached or any part thereof the same in your Custody safe keep so that you have the same before our Justices of our County Court of Somerset to be held at dividing Creek the third tuesday of August next then and there to be Condemned According to Act of Assembly to and for the use of a certain Robert King unless the said Thomas Gray by himself or his attorney shall appear and answer unto the said Robert King in a plea of trespass upon the case &a According to law and that by good and lawfull men of your bailywick you make known unto the person or persons in whose hands you make the same attachment that he she or they be and appear before our Justices of our County Court to be held as afd to shew cause if any he she or they have why the same goods Chattells rights or Creditts so attached in his or their hand ought not to be Condemned and Execution thereof had and made according to act of assembly (in such case made and provided) if to him her or them it shall seem meet and how you shall Execute this Writt that you make known unto our said Justices of our said Court the Nin^e^teenth day of June in the twenty second Year of our Dominion &c Anno Dom one thousand seven hundred and thirty six Att which said third Tuesday of August to witt the seventeenth day of the same month anno Dom One thousand Seven hundred and thirty Six being the day of the Return of the said writt Cometh the said Robert King by Robert Jenckins Henry his attorney and the Sheriffe of Somerset County to whom the foregoing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words viz.t By Vertue of the within Writt to me directed on the tenth day of July seventeen hundred and thirty Six I have attached of the goods and Chattells of the within Named Thomas Gray in the hands of Martin Fenton and Esther Tull and in Each of them the five hundred pounds of tobacco in the within Writt Contained and by Francis Porter & John Doe good and Lawfull men of my Bailywick made known unto the said Martin Fenton and Esther Tull that they be and appear before the Justices of the County Court of Somerset to Shew Cause &.a why &.a as by the ^within^ writt I am Commanded so answers Jos: Macclester sher Whereupon the afd Esther Tull and Martin Fenton Garnishes of the afd Thomas Gray in their proper persons appears and saith that they Cannot Gainesay but that they have of the Rights and Creditts of the said Thomas Gray the said Esther Tull to the Value of thirteen shillings & eight pence and the said Martin Fenton to the Value of three pounds Two shillings Curr.t money nor Can they say but that the same Ought to be Condemned in their hands for the Use of the said Robert King as of the Rights and Creditts of the said Thomas Gray which the said Plft doth not Gainsay &a whereupon |
