232 Contrary to the peace of the said Lord proprietary that now is his good rule and Goverment and against the form of the Act of Assembly in such case lately made and provided &c On the backside of the foregoing Bill of Indictment it was Endorsed vizt Billa Vera Sam.l Wilson Foreman Thereupon Command was given to the Sheriffe of Somerset County that he Should take the said Eliz.a Waler if &.a to answer &.a and afterwards to witt the Seventh day of August Anno Dom One thousand seven hundred and thirty Six before the Justices of his Lordships County Court of Somerset now here held at Dividing Creek in the Same County Came the said Eliza Walter in her proper person and had a hearing of the Indictment afd who thereupon says that she is Guilty thereof and is willing to pay her fine for the fact afd and makes Oath that a Certain Edward Hargis is the father of the Child she stands Indicted for whereupon all and Singular the premisses by the Court here being seen heard and fully understood Therefore it is Considered by the Court here that the afd Eliza Walter pay unto his Lordship the Lord Proprietary for her fine by the Court hereupon her Imposed for and by Occasion of the premisses afd whereof in form afd she is Convict thirty Shillings Curr.t money of Maryland for the use of the County afd and that the said Eliz.a Walter be taken to Satisfie his said Lordship of the fine afd Whereupon the said Eliz.a Walter is ordered to give security to save and keep Indemnified the Justices of Somerset County Court and their Successors for the time being from all Costs Charges Troubles and burthens that might accrew by means of the birth &.a of the afd Child &a Thereupon the said Eliz.a Walter with Humphry Chapman Late of Somerset County planter her security both present herein Court in their proper persons acknowledged themselves Indebted unto his Lordship the Lord Proprietary in the Sum of thirty pounds Sterling good and Lawfull money of England of their Severall goods and Chattells Lands and tenements to the use of the County of Somerset to be made and Levied if it Happen that the Said Eliz.a Walter her heirs Executors and adm.rs or any of them do and shall not from time to time and at all times forever hereafter acquitt discharge and Save harmless as well the Justices of Somerset County Court for the time being and their Successors as also the Inhabitants of the Same County from all Costs Charges and troubles whatsoever for or by reason of the birth maintainance nourishing and bringing up of the afd Child and of and from all Other suits Costs, Charges, Burthens troubles and demands whatsoever touching or Concerning of the Same &a Likewise the said Eliz.a Walter is ordered by the Court to give Security for the payment of the Severall Officers Fees due by occasion of the premisses afd Whereupon the afd Humphry Chapman present here in Court acknowledged himselfe Indebted unto his Lordship the Lord Proprietary in ten pounds Sterling to be Levied of his body goods or Chattells Lands and tenements to be made and Levied if it happen that the said Humphry Chapman do not pay unto the Severall officers their Fees due by means of the premisses afd &a |
