228 somerset County planters in their proper persons and acknowledged themselves Indebted unto his Lordship the Right Honrble the Lord Proprietary that is to say the said Saul Townsend in Twenty pounds Sterling and the said Joshua Caldwell and Benjamin Langford in ten pounds Sterling Each of their goods and Chattells Lands and Tenements of Every of them Severally to be made and Levied to the use of his said Lordship his heirs and successors If it happen that the said Saul Townsend do not make his personall appearance before the Justices of his Lordships County Court of Somerset to be held at diving dividing Creek in the County afd the third tuesday of November next to answer unto his Lordship the Lord Proprietary of and Concerning a Certain trespass and assault by him Committed and done on a Certain James Houlston and do not stand and abide the Judgment of the Court thereon and do depart the Same Court without Leave and in the mean time if she ^he^ is not of the good behaviour towards his said Lordship and all others his good people and more Especially towards the said James Houlston &a Likewise the afd James Houlston present herein Court is ordered to give recognizance for his appearance before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of November next to give Evidence and prosecute the said Saul Townsend for an assault &a Thereupon the said James Holston present herein Court in his proper person and acknowledged himselfe Indebted unto his Lordship the Lord Proprietary in ten pounds Sterling good lawfull mony of England to be made and Levied to the use of his said Lordship his heirs and Successors If it Happen that the said James Holston do not make his personall appearance before the Justices of his Lordships County Court of Somerset to be held at dividing Creek in the Same County the third Tuesday of November Next and do not then and there give Such Evidence as he Knows on behalfe of his Lordship against Saul Townsend and do depart the same Court without Leave &a Ordered that Thomas Williams put out and agree with Somerset person or persons to take Care of a Certain Avis Barnes a poor Object thats not Capable of taking Care of her selfe to keep find and provide for the said Avis Barnes all Such Necessarys as may be sufficient for her Support untill November Court next in this her poor weak Condition and he she or they so finding and keeping of the same Avis Barnes with nessarys as afd for her Support to be allowed for the Same next Levy Court &a It appearing to the Court hereby the mocon of Levin Gale Esq.r that the two sons of Alex.d Carlyle of Somerset County Gent dec.d under the Care of Cap.t John Macclester their Guardian appointed is likely to Inherit a Considerable Estate in Scotland &.a Whereupon it is ruld by the Court here that the said John Macclester Guardian as afd have the Liberty of Sending the afd Children to Scotland to their relation there in order to Inheritt the Estate afd Mr Stoughton one of the Justices Enters his disassent thereto but is willing that the Children be removed to any other person but not to goe to Scotland &a |
