22 there being with force and arms an assault did make and the said Philip then and there did Beat wound and evilly treat so that of his Life it was greatly despaired and other harms to him then and there did to the great damage of the Same Philip and against the peace of the said Lord propry that now is his good rule and government Test Philip Selby One the Backside of the foregoing Bill of Indictment it was thus Endorsed vizt Ignoramus p Josa Caldwell foreman Whereupon the said Elisha Hill in his Own proper person Came hereinto Court and prays that his appearance may be recorded to Save himselfe and Security for a Certain recognizance before by him and his security first acknowledged thereupon the said Elisha Hills appearance is recorded and he and his security discharged Upon this the said Elisha is ordered to give Security for the payment of the Severall Officers their Fees due by Occasion of the premisses on the Indictment and recognizance afd &a Thereupon Johnson Hill of Somerset County planter present herein Court in his proper person undertook for said Elisha Hill and acknowledge himselfe Indebted in five pound Sterling to be Levied &a If it Happen that the said Johnson Hill do not pay unto the Severall Officers their Fees due as afd upon the premisses aforesaid &a
hundred thirty and five at the parish afd ^in the County afd^ within the Jurisdiction of this Court in and upon Philip Selby in the peace of God and of the said Lord proprietary then and there being with force and arms an assault did make and him the said Philip then and there did beat wound and Evilly treat so that of his life it was much despaired and other harms to him then and there did to the great damage of the said philip and against the peace of the said Lord proprietary his Good rule and Dignity &a Test Philip Selby On the Back side of the foregoing Bill of Indictment it was Endorsed Vizt Ignoramus p Josa Caldwell foreman Whereupon Came here into Court the afd Hutton Hill in his proper person and prays that his appearance may be recorded to Save himselfe and security from a Certain Recognizance of Bail before acknowledged thereupon |
