207 Parish afd Seven thousand Eight hundred pounds of tobacco and from the vestry of Somerset parish af.d seven thousand pounds of tobacco for the use of the same James Robertson and altho the same Francis hath paid and satisfied unto the af.d James parcell of the same sums of tobacco Nevertheless as to seven hundred and seventy six pounds of tobacco the Residue the same Francis altho' often required hath not paid but that to him to pay altogether hath refused and still doth refuse to the damage of the same James five thousand pound^s^ of tobacco and thereof he brings Suit &.c pledges &a John Doe & R Roe And the said Francis Allen in his own proper person Comes and defends the force and Injury when &a and prays Leave thereof to Imparle hereuntill next Court and he hath it and the Same day is given to the afd James here also &a Att which said next Court to witt Sixteenth day of March anno Dom One thousand Seven hundred & thirty five Came againe as well the said James Robinson by his attorney afd as the said Francis Allen in his Own proper person and whereupon the same Francis prays further Leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the afd James here also &a Att which said next Court to witt the fifteenth day of June anno Dom One thousand Seven hundred and thirty Six Came againe as well the afd James Robinson by his attorney afd as the afd Francis Allen in his proper person and whereupon the Same Francis as before defends the force and Injury when &.a and saith that he doth not Owe unto the afd James the afd Seven hundred seventy Six pounds of tobacco or any pound thereof and of this he puts himselfe upon the Country and the afd James Robertson in Like manner Thereupon it is Commanded the Sheriffe of Somerset County that Immediately he Should Cause to Come here before the Justices of his Lordships County Court of Somerset now Sitting at dividing Creek in the same County twelve &.a by whom &.a and who neither &.a to recognize &.a because as well &.a and afterwards Immediately Came thereof the Jury &.a and the Jurors of that same Jury by Joseph MccClester ^Gent^ sheriffe of the County afd to this Impannelled being Called Came to witt Robert Jones Jos: Wailes, James Nearn, Christopher Nutter Angello Atkinson, William Porter Thomas Winder Thomas Peal Jonathan Sturges, John Reddish Charles Townsend and John Roach who to say the truth of the premisses afd being duely Elected tryed and Sworn upon their Oath do say that the aforesaid Francis Allen doth Owe unto the afd James Robertson three hundred & Eleven pounds of tob.o parcell of the afd Seven hundred and seventy Six pounds of tobacco in manner & form as the afd James above against him hath declared &a Wherefore for that the said three hundred and Eleven |
