208 Eleven pounds of tob.o by the Jurors afd in form afd found being not within the Jurisdiction of the Court to give Judgment thereon for the plft &.a Therefore it is Considered that the afd James Robertson take nothing by his Bill afd but be in mercy for his false Clamour and that the said Francis Allen goe thereof without day and further it is Considered by the Court here that the said Francis Allen recover against the afd James Robertson 106 pounds of tobacco for his Costs and Charges by him about his defence in that part sustained to the same Francis by the Co.t here according to the form of the Statute in Such Case thereof made and provided of his assent adjudged & that the afd Francis have thereof Execution &a
that he render unto him fifteen pounds currant money of this province which from him he unjustly detains &c And Whereupon the said Southy by Francis Allen his attorney complains that whereas the said Eliz.a in her lifetime to witt ^on^ the twenty first day of December Anno Dom seventeen hundred and thirty three at the County of Somerset af.d within the Jur of this Court by her certain writing obligatory which the said southy with the seal of the said Eliz.a in her life time signed here into Court brings the date whereof is the same day and year did covenant and promisse to pay unto him the said Southy the Just sume of fifteen pounds Currant money of this province at the reasonable request and demand of him the said Southy Nevertheless the said Eliz.a in her life time nor the af.d Isacc since decease of the said Eliz.a tho often thereunto required the said Fifteen pounds to the said southy have not rendred but the same to the said southy to render the Eliz.a in her life time time and the said Isaac since the decease of the said Eliz.a have refused And the said Isaac the same to the said southy to render still doth deny and unjustly detain Whereupon he saith he is worse a hath damage to the value of thirty pounds currant of Maryland And thereupon he brings suit &c Pledges &a Jno Doe R Roe And the afd Isaac Morris by William Beckingham his attorney Cometh and defendeth the force and Injury when &a and prayeth Leave thereof to Imparle hereuntill next Court and he hath it and the same |
