204 writt in these words following Viz.t Somerset sst Charles absolute Lord and Proprietary of of the provinces of Maryland and avalon Lord Baron of Baltemore &.a To the sheriffe of Somerset County Greeting Whereas Theodore Bere lately in our County Court of Somerset to witt the twentieth day of November one thousand seven hundred and thirty three before Robert King Gentleman and others his associates then our Justices of our same Court at dividing Creek in the County af.d by Consideration of the same Court recovered against William Andrews late of Somerset County Gen.t two thousand one and fifty two pound of tobacco for his damages which he Sustained as well by Occasion of the non performance of a certain promise and assumption by the af.d William Andrews to the af.d Theodore Bere lately made as for his costs and Charges by him about his Suite in that part apposed whereof he is Convict as by the records and preceding thereof in our same Court before our Justices at dividing Creek remaining manifestly appeareth and afterwards the af.d Theodore Bere died Intestate as tis said after whose death Administration of all ^and^ Singular the goods and Chattells rights and Creditts which were of the af.d Theodore at the time of his death by Nehemiah King Gentelmen deputy Comissary in and for the County af.d To Thomas Lambden of Somerset County Gen.t in due form of law was Commited as on the part of the af.d Thomas in our Court before us we have rec.d which altho' Judgment be thereof be rendered Execution not with standing of the damages af.d as yett remaineth to be made in retardation of the Execution of the of the administration af.d whereof to us is supplicated by the same Thomas for himselfe of a proper remedy in that part to be provided and we in that part being willing that right and Justice to him be done Command you that by honest and lawfull men of your bailywick you make known to the af.d William Andrews that he be and appear before our Justices of our County Court of Somerset to be held at dividing Creek in the County af.d the third tuesday March next to shew cause if any thing for himselfe he hath or to say knoweth wherefore the af.d Thomas Lambden should not have Execution against him for the damage af.d According to the form of the recovery af.d if to him it seemeth Expedient and have you then and there the names of them by whom to him is made known and this writt Wittness Robert King Gent Chiefe Justice of our same Court the 27.th day of Nov.r anno Dom 1735 Att which said third Tuesday of March to witt the Sixteenth day of the Same month anno Dom One thousand Seven hundred & thirty five being the day of the Return of the Same Writt Came the said Thomas Lambden by Francis Allen his attorney at Dividing Creek in the Same County and the sheriffe of Somerset County to witt Joseph MccClester Gent at the Same day Returned that the afd W.m Andrews hath nothing in his Bailywick whereby or by which to him he could make known nor is found in the Same and the afd William Andrews Cometh not therefore as before it is Commanded the sher of Somerset County that by honest |
