203 to me directed to the Justices within Mentioned I Certifie that on the fourteenth day this Instant I have attached in the hands of William Whittington of the goods and Chattells rights and Creditts of John Donelson for the use of Capt John Donelson for the Use of Capt Samuel Hopkins to the Value of fifteen pounds Curr.t money and in the hands of Presgrave Turvill to the Value of Fifteen pounds Fifteen shillings and ten pence Curr.t money of Maryland and further Certifie that by John Doe and Richard Roe good & Lawfull men of my Bailywick that they be & appear at the time and place within Contained and I further Certifie to the afd Justices that the said John Hath not at this time any other goods Chattells rights or Creditts in my Bailywick by which he may attach so answers Joseph MaClester sher Whereupon the afd Presgrave Turvill Garnishee of the afd John Donelson appears in his proper person and saith that he Cannot gainsay but that he hath of the Rights and Creditts of the said John Donnelson to the value of the afd Nine pounds Fifteen Shillings and tenn pence Curr.t money of maryland so as afd attached and not more nor Can he say but that the Same Ought to be Condemned in his hands for the Use of the Said Samuel Hopkins as of the rights and Creditts of the said John Donelson which the said plft doth not gainsay Whereupon the said Samuel Hopkins by his attorney afd prays that upon giveing Security according to act of assembly in such Case provided that the afd Sum of Nine pounds Fifteen Shillings and Tenn pence Currt money so as afd attached and Confessed by the said Presgrave Turvill as of the Rights and Creditts of the said John Donelson may be Condemned in the hands of the said Presgrave Turvill towards Satisfying unto the said Samuel Hopkins his damages and al Costs and Charges accrewing on the writt of attachment afd &a Thereupon a Certain Francis Allen of Somerset County Gent present herein Court undertakes for the said Samuel Hopkins according to act of assembly in such Case made and Provided that if in Case the said John Donelson do at any time within a year and a day appear and make all or any part of the said Samuel Hopkins's Claim against him appear to be satisfied or otherwise to have been undue before the Laying of the attachment afd that then the said Samuel Hopkins Shall make restitution unto him the said John Donelson of all or such part thereof as shall be made appear to be undue &.a or that he the said Francis Allen will do the same for him &a Therefore it is Considered by the Justices here that the afd Sum of nine pounds fifteen shillings and tenn pence Curr.t money of maryland so as afd attached and Confessed be Condemned in the hands of the said Presgrave Turvill as of the Rights and Creditts of the said John Donelson towards Satisfying unto the said Samuel Hopkins as well his damages as also all Costs and charges accrewing upon the attachment afd & that he have thereof Execution &a Likewise the afd William Whittington Gar as afd by Fran: Allen his attrny appears & Imparles &a
