201 seem mete and how you shall Execute this writt that you make known unto our said Justices at the day and place af.d and have you then and there this writt Wittness John Smith Gen.t one of our Justices of our said Court the twentieth day of March Anno Dom one thousand seven hundred and thirty five Att which said third Tuesday of June to witt the fifteenth day of the same month anno Dom one thousand seven hundred and thirty Six being the day of the return of the said Writt Came the said Wm MccClemmey by Francis Allen his attorney and the sheriff of Somerset County to whom the foregoing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed in these words following viz.t I hereby Certifie that on the Twenty Eighth day of May Seventeen hundred and thirty Six at Somerset County I attached of the goods and Chattells of Thomas Gray for the use of William McClemey within Mentioned to the Value of two pounds tenn shillings as p the schedule hereunto annexed may appear and those goods and Chattles in due form of Law did Cause to be appraised and I further Certifie that I attached the sums within Mentioned in the hands of Richard Phillips Robert Collier and Edw.d William and Thomas Shiles and made known unto them Severally that they sho'd be and appear at the day and place within mentioned to shew Cause as therein is directed before before John Doe and Richard Roe good and Lawfull men of my Bailywick so answers Joseph McClester sher May the 28.th 1736 Somerset County Wee Charles Ballard Thomas Dashiell John Covington and John Dorman being Legally Somoned and Sworn by the Sheriff of said County to appraise a flatt brought to our view by said sheriffe as the goods of Thomas Gray merch.t attached by W.m MccClemmey and we the Subscribers do find the said flatt to be of the value of fifty shillings Charles Ballard Thomas Dashiell Jun.r John Covington John Dorman Whereupon Came herein Court the afd Edward Williams and Thomas Shiles Garnishees of the afd Thos Gray in their proper persons and the said Edward Williams saith that he Cannot Gainsay but that he hath of the Rights and Creditts of the said Thomas Gray to the Value of Six shillings and the said Thomas Shiles says that he Cannot gainsay but that he hath of the Rights and Creditts of the said Thomas Gray to the Value of Fifty Shillings Curr.t money and not more nor Can they say but that the Same ought to be Condemned in their hands towards Satisfying unto the said William MccClemmey as well the Sum of seven pds Seven Shillings and Eleven pence Curr.t money as also all Costs and Charges accrewing upon the writt of attachment afd &a Thereupon the said William MccClemmey by his attorney afd prays the Court that upon Giving Security according to act of assembly in such Case made and provided that the afd sum of Six shillings Currt money and the afd sum of Fifty Shillings Currt money afd Confessed be Condemned in |
