201 the said Thomas Gray which the said William MccClemmey doth not gainsay &a Whereupon the said William MccClemmey by his attorney afd prays that upon Giveing Security according to act of assembly in such Case made and provided that the said sum of Twenty Six shillings Curr.t money part of the sum so attached and Confessed be Condemned in the hands of the said John Abbott as of the Rights and Creditts of the said Thomas Gray and that the severall goods and Chattells afd attached of the Value of three pounds twelve shillings Curr.t money be Condemned as the goods and Chattells of the said Thomas Gray towards Satisfying unto the said William MccClemey his damages as also all Costs and Charges accrewing upon the writt of attachment afd &a Thereupon Edward Rownd and Charles Rackliffe of Somerset County Gent both present herein Court in their proper persons acknowledged themselves Securitys and undertook for the said William MccClemmey according to act of assembly that in Case the said Thomas Gray do at any time within a year and a day appear and make all or any part of the said William MaClemmeys Claim against him appear to be satisfied or otherwise to have been undue before the Laying of the attachment afd that then the said William McClemmey shall make restitution unto him the said ^Thos Gray^ of all or Such part thereof as shall be made appear to be undue &.a or that they the said Edw.d Rownd and Charles Rackliffe will do the same for him &a Therefore it is Considered by the Justices here that the afd sum of Twenty Six shillings Currt money so as afd Confessed be Condemned in the hands of the said John Abbott as of the Rights and Creditts of the Same Thos Gray towards Satisfying unto the said William MaClemmey his damages afd & all Costs and Charges accrewing upon the writt of attachment afd & that he there have thereof Exn Likewise it is Considered by the Justices here that the afd Severall Goods and Chattells so as afd attached of the Value of three pounds twelve shillings Curr.t money of Maryland be Condemned as the proper goods and Chattells of the said Thomas Gray towards satisfying unto the said William MaClemmey his damages afd and all Costs and Charges accrewing upon the writt of attachm.t afd and that the said William MaClemmey have thereof Exn &a Memorand.m the Garnishee of John Abbott voluntarily takes his Oath that he hath noe more of the Effects in his hands of the defts than what he hath Confessed Memorand.m George Phebus Jun.r another of the afd Garnishees is discharged by the plft from the attachment afd Likewise John Waters an Other of the Gar.s appears by Robert Jenckins Henry his attorney and Imparles till next Court &a |
