200 and there to be Condemned according to act of assembly to and for the use of a certain W.m McClemmey unless the said Thomas Gray by himself or his attorney shall appear and answer unto the said William McClemmey in a plea of trespass upon the case &.a According to Law and that by good and lawfull men of your bailywick you make known unto the person or persons in whose hands you make the same attachment that he she or they be and appear before our Justices of our County Court to be held as af.d to shew cause if any he she or they have why the same goods Chattles rights or Creditts so attached in his or their hands ought not to be Condemned and Execution thereof had and made according to act of assembly in such case made and provided if to him her or them it shall seem meet and how you shall Execute this writt that you make known unto our said Justices at the day and place af.d and have you then and there this Writt Wittness John Smith Gen.t one of our Justices of our said Court the twentieth day of March Anno Dom one thousand seven hundred and thirty five Att which said Third tuesday of June to witt the Fifteenth day of the Same month anno Dom One thousand Seven hundred and thirty Six being the day of the Return of the same Writt Came the said William MccClemmey by George Douglas his attorney and the Sheriff of Somerset County to whom the foregoing writt was directed and Likewise Came and made Return thereof to the Court here Endorsed vizt I hereby Certifie that on the Twenty six day of March seventeen hundred and thirty six I attached at Somerset County for the use of William MccClemmey of the goods and Chattells of the within named Thomas Gray to the Value of three pounds twelve shillings as p the shedule hereunto annexed may appear and those goods and Chattells in due form of Law did Cause to be appraised and I further Certifie that I did attach the sums of money and tobacco within Mentioned Seperately in the hands of John Waters John Abbott and George Phebus's Jun.r and did Severally make Known that they Sho'd be and appear at the day and place within mentioned to Shew Cause &.a as therein is Contained before Joshua Merrill good and Lawfull men of my Bailywick so answers Jos: Macclester sher A schedule of the goods of Thomas Gray attached for the Use of W.m MccClemey and appraised as follows
Whereupon the afd John Abbott Garnishee of the afd Thomas Gray appears in his own proper person and saith that he Cannot gainsay but that he has of the Rights and Creditts of the said Thomas Gray to the Value of One pound six shillings Curr.t money of maryland nor but that the Same ought to be Condemned in his hands for the Use of the said William MccClemmey as of the Rights and Creditts of the |
