terminer and Goal delivery to be held for Somerset County at dividing Creek the first tuesday of september next to give Evidence on behalfe of his Lordship against the Said Jeremiah Lilley &a Thereupon the said Alexander Fullerton present herein Court acknowledged himselfe Indebted unto his said Lordship the Lord Proprietary in the Sum of twenty pounds Sterling good and Lawfull money of England of his body goods or Chattells Lands and tenements to the Use of his said Lordship his heirs & successors to be made and Levied if it Happen that the said Alexander Fullerton do not make his personall appearance before the Justices of the next assize nisi prius oyer and terminer and Goal deliver to be held for somerset County at dividing Creeks the first tuesday of September next and do not then & there give such Evidence as he knows against Jeremiah Lilley of and Concerning his feloniously stealing of goods and Chattells from him the said Alex.d and do depart without Leave of that Same Court &a
I doe hereby requir^e^ you to Issue attachment for the sum of three pounds starling with Lawfull damages against the effects of the af.d Thomas Gray agreeable to the act of assembly in such case provided And for soe doeing this shall be your warrant dated at dividing Creek this 22.d of nov.r Anno Dom 1735 RKing To M.r Thomas Hayward Clerk of Somerset County These Pursuant to an act of assembly of this province now in force and in Obediance to the above said Warr.t the Following attachment against the goods Chattells Rights and Creditts of Thomas Gray vizt Somerset sst Charles absolute Lord and proprietary of the provinces of Maryland and avalon Lord Baron of Baltemore &.c To the sheriff of Somerset County Greeting we Command you that you attach the goods Chattles rights or Creditts of Thomas Gray late of Somerset County Merchant if they shall be found in your bailywick to the value of three pounds fifteen shillings Sterling and four hundred pounds of tobacco ^and^ when you have the same attached or any part thereof the same in your Custody safe keep so that you have the same before our Justices of our County Court of Somerset to be held at dividing Creek the third tuesday of June next then and there to be Condemned according to act of assembly to and for the use of a certain Samuel Wilson unless the said Thomas Gray by himself for his attorney shall appear and answer unto the said (Samuel) |
