County af.d within the Jurisdiction of this Court two white Linnen shirts of the value of fifteen shillings current money of Maryland each and one Linnen wastcoat of the value of five shillings like money of the goods and Chattles of William Turpin then and there being found then and there feloneously did steal take and bear away contrary to the peace of the said Lord proprietary his good rule and Goverment and against the form of the act of assembly in such case lately made and provided &.c Test William Turpin Alexander Fullerton On the backside of the foreging Bill of Indictment it was thus Endorsed vizt Samuel Wilson foreman Thereupon Command was given to the Sheriffe of Somerset County that he Should take the said Jeremiah Lilley if &.a to answer &.a and afterwards to witt the fifteenth day of June anno Dom one thousand seven hundred and thirty Six before the Justices of his Lordships County Court of Somerset now here held at dividing Creek in the Same County Came the said Jeremiah Lilley in his proper person under Custody of the Sheriffe of Somerset County into whose Custody before that time was Committed for the Cause afd and being by the said sheriff Led to the Barr is thereupon Instantly demanded how he would acquitt himselfe of the felony afd as by the Indictment afd is above against him Imposed who thereupon says that he is not guilty thereof and of this he puts himselfe upon the Country and William Godsborough Gent who for his said Lordship in in that part Followeth Likewise &a Thereupon it is Commanded the Sheriffe of Somerset County that Immediately he should Cause to Come ^here^ before the Justices afd twelve &.a and who neither &.a to Recognize &.a because as well &.a and afterwards Immediately Came thereof the Jury &.a and the Jurors of that Same Jury by Joseph MccClester Gent sheriffe of the County afd to this Impannelled being Called Came to witt Robert Jones Joseph Wailes James Nearn Christopher Nutter Angello Atkinson William Porter Thomas Peal Thomas Winder Johnathan Sturges John Reddish Charles Townsend and John Roach who to say the truth of the premisses afd being duely Elected tryed and Sworn upon their Oath do say that the said Jeremiah Lilley is guilty of the feloney afd as by the Indictment afd above upon him Imposed in manner & form above Supposed whereupon All and Singular the premises by the court here seen heard and fully understood Thereupon the Court here according to act of assembly in Such Case made and provided valued the two shirts & wastcoat ^in the Indictment afd mentioned^ to Seventeen shillings and Six pence Curr.t money of maryland Thereupon it is Considered by the Justices here that the said Jeremiah Lilley pay unto the afd Wm Turpin the party afd deprived four fold of the value of the afd two Shirts and one white Wastcoat in the Indictment |
