189 If it Happen that the said John Starling Jun.r do not make his personall appearance before the Justices of his Lordships County Court of Somerset top be held at dividing Creek in the Same County the third Tuesday of August ^next^ and do not then & there give Such Evidence as he knoweth against a Certain John Redding and do depart the ^same^ Court without Leave &a Benjamin Townsend of Somerset County Gent having Obtained his Lordships Lycence for the keeping a Ferry over wickacomoco River near white Haven Town at the Usual place Came hereinto Court and agrees with the Justices of Some Court for the keeping of a Free Ferry for the Use of the County afd In consideration whereof and keeping a good Boat and attendance thereto belonging the said Benjamin Townsend to be allowed the Usuall allowance p the Year &a
within the Jurisdiction of this Court did Committ fornication with a Certain person to the Jurors afd unknown and did permitt the Same unknown person then and there to have Carnall knowledge of her body and to begett then and there a bastard Child on the Body of her the Same Rose to the high displeasure of almighty God to the evill Example of all Others in Such Case offending Contrary to the peace of the said Lord Proprietary that now is his good rule and Government against the form of the act of assembly in such Case made and provided &a Test Wheatley Dennis On the Backside of the foregoing Bill of Indictment it was Endorsed in these words Following Vizt Billa Vera Edmond Hough foreman Thereupon Command was given to the Sheriffe of Somerset County that he should take the said Rose Williams if &.a to answer &.a and afterwards to witt the fifteenth day of June anno Dom one thousand seven hundred & thirty Six before the Justices of his Lordships County Court of Somerset now here held at dividing Creek in and for the Same County Came the said Rose Williams in her proper person and had a hearing of the Indictment afd who says that she is not guilty thereof and of this she putts herselfe upon the Country and Wm Goldsborough Gent his Lordships attorney and who for his said Lordship in that part Followeth Likewise And forasmuch as it doth appear to the Court here that the said Rose Williams is a maried woman ^&a^ afterwards to witt the Same day and Year Came hereinto Court the afd W.m Goldsborough who for his said Lordship in this part Followeth and Freely saith herein Court that he will noe further prosecute the afd Rose Williams in the premisses |
