180 Cometh and maketh return thereof to the Court herein these words following vizt Cepi Corpus P Jos: MaClester sher Whereupon the Same Sheriff to witt Joseph MccClester Gent at the Same day being Solemnly Called brings not in the body of the Same Domnick Haley according to the return of the writt afd in the plea afd but makes default &a Therefore at the prayer of the afd George Sharpe by his attorney afd It is Considered by the Justices here that the afd Sheriff to witt Joseph MaClester be amerced to his Lordship the right Honrble the Lord Proprietary for his default afd the afd Sum of Five pounds Nineteen shillings and four pence Curr.t money of Maryland in the declaration afd Specified as also 224 pounds of tobacco for Costs and Charges Expended in prosecuting of the action afd by the Court here adjudged and the afd sher in Mercy &a
Sixteenth day of march in the year of our Lord God one thousand seven hundred and thirty five before John Smith Gen.t and his associates the said Lord proprietary his Justices of the same County Court and for the same Lord proprietary doth give the same Justices hereto understand and be Informed that John Kenney late of Somerset County planter the tenth day of January Anno Dom one thousand seven hundred and thirty five at the parish af.d in the County af.d within the Jurisdiction of this court in and upon a Certain Isaac Knott of the same County Carpenter an assault did make and him then and there did beat wound and evilly treat so that of his life it was greatly despaired and other harms to him then and there did to the great damage of the same Isaac Knott and against the peace of the said Lord proprietary that now is his good rule and Government &.c whereupon the same attorney of the said Lord proprietary for the same Lord proprietary prayeth the advise of the Court herein the primisses and that due process of Law in that part against the af.d John Kenney may be made to answer unto the same Lord proprietary of and upon the premisses &.c thereupon Command was given to the sheriff of Somerset County that he should take the said John Kenney if &.a to answer &.a and afterwards to witt the Sixteenth day of March anno Dom one thousand Seven Hundred and thirty five before the Justices of his Lordships County Court of Somerset now here held at dividing Creek in and for the same County Came the said John Kenney in his proper person according to a Certain recognizance by him and his Security before acknowledged and had a hearing of the Information afd who thereupon saith that of the trespass and assault afd as by the Information afd above upon him is Imposed he is guilty thereof Whereupon all and Singular the premisses by the Court here being seen heard and fully understood &a It is considered by the Justices here that the said John Kenney pay unto his Lordship the Lord Proprietary for his fine by the Court here upon him Imposed for and by occasion of the trespass and assault and whereof in form afd he is Convict two shillings and |
