to be held at Dividing Creek the third tuesday of March than next to answer unto George Sharpe of a plea of trespass upon the Case &.a and that thereof he should not fail &a And the said George Sharp by William Beckingham his attorney Complains against the said Domnick Haley in the plea afd as Followeth vizt Somerset ss.t Domnick Haley Late of Somerset County planter was attached to answer unto George Sharpe in a plea of trespass upon the Case &a And whereupon the said George by William Beckingham his attorney Complaines that whereas the said Domnick the first day of August anno Dom Seventeen hundred and thirty five at Somerset County afd within the Jurisdiction of this Court was indebted unto the said George in five pounds nineteen Shillings and four pence halfe penney Curr.t money of Maryland for Sundrys properly Chargable in acco.t as by acco.t thereof hereunto annexed may in Court appear and being so thereof Indebted the said Domnick in Consideration thereof the day and year afd at the place afd upon himselfe did assume and to the said George then and there did faithfully promise that he the said Domnick the said five pounds nineteen shillings and four pence halfe penny Curr.t Money to the said George when he Should be afterwards thereunto Requested he would well and faithfully pay and Content Nevertheless the said Domnick his promise and assumption afd in form afd made nothing regarding but plotting and fraudulently Intending the said George in that part Craftilly and Subtilly to deceive and defraud the said five pounds Nineteen shillings and four pence halfe penney to the said George altho' the Same to do the sid Domnick by the said George on the first day of November in the Year afd and often afterwards at the County of Somrset afd he was thereunto requested hath not paid or Contented but the Same to him hitherto to pay hath refused and still doth refuse and deny to the damage of the Same George of Ten pounds Curr.t money afd and thereof he brings suit &a Pledges &.a John Doe R Roe
seven hundred and thirty five being the day of the Return of the said Writt Cometh the said George Sharp by his attorney afd and the Sheriff of Somerset County to whom the foregoing writt was directed Likewise |
