179 same day and year afd at the County afd upon himselfe did assume and to the same Michael in his life time then and there faithfully did promise that he the same Thomas the same three pounds Sixteen shillings to the same Michael when thereof afterwards he should be required well and faithfully would Content and pay nevertheless the afd Thomas his promise and assumption afd in form afd made nothing regarding but minding and fraudulently Intending the same Michael in his Life time and the afd Elizabeth the Executrix whilst sole and the afd William and Eliz.a since the espousalls between them had and Celebrated in this part Craftilly and Subtilly to deceive and defraud the afd three pounds sixteen shillings to the afd Michael in his Life time or to the afd Elizabeth the Executrix whilst she was sole or to the afd William and Elizabeth since the Espousalls between them had and Celebrated or Either of them hath not paid altho' often thereto required by the aforesaid Michael in his Life time and by the afd Eliz.a the Executrix after the death of the afd Michael whilst sole and by the afd William and Elizabeth since the espousals between them had and Celebrated particularly by the same ^William &^ Elizabeth since their Espousals on the first day of November in the Year seventeen hundred and thirty five but that to the afd Michael in his Life time or to the afd Elizabeth the executrix whilst sole or to the afd William and Elizabeth since the espousals between them Celebrated or either of them hath not paid but the same to them or Either of them to pay hitherto altogether have refused an still do refuse to the damage of the same William and Elizabeth the Ex.rx Seven pounds twelve Shillings and thereof they bring suit &.a and bring into Court the Letters Testamentary of the same Eliz.a whereby it may appear to the Court here that she is executrix of the testament of the same Michael and thereof &a pledgs &.a Jno Doe & Rd Roe Att which said Third tuesday of march to witt the sixteenth day of the same Month anno Dom one thousand seven hundred and thirty five being the day of the return of the same Writt Came the said William Beckingham and Elizabeth his wife Executrix as afd by their attorney afd and the sher of Somerset County to whom the foregoing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed in those words following vizt Cepi Corpus p Jos: MaClester sher Whereupon the said sheriff to witt Joseph MaClester Gent at the same day being solemnly Called brings not in the body of the same Thomas Cromwell according to the return of the Writt afd in the plea afd but makes default &a therefore at the prayer of ^the afd^ William Beckingham and Eliz.a his wife Executrix as afd by their attorney afd it is Considered by the Justices here that the afd sheriff to witt Joseph MaClester Gent be amerced to his Lordships the Right honrble the Lord Proprietary for his default afd the afd Sum of three pounds sixteen shillings Curr.t money of Maryland in the declaration afd Specified as |
