168 For as much as Fortune Gam had not burnt so much tobacco as by Law she was Oblidged to burn but is willing to pay her fine for the same &.a Wherefore it is Considered by the Court here that the said Fortune Gam pay unto his Lordship the Lord Proprietary for her fine for and by Occasion of the premisses afd Twenty Shillings Curr.t money of Maryland And that she be taken &a For as much as a Certain Thomas Walter had not burnt so much tobacco as by Law she was obliged to burn but was willing to pay her fine for the Same &.a Wherefore it is Considered by the Court here that the afd Thomas Walker pay unto his Lordship the Lord propry for his fine for and by Occasion of the premisses afd Forty Shillings Curr.t money of maryland and that he be taken &a Dennis Driskill of Somerset County planter being attached by the Sheriff of Somerset County for not appearing at Last November Court held for Somerset County at dividing Creek he being Legally somoned thereto Now hereat this day to witt the Sixteenth day of March anno Dom 1735 Came the said Dennis Driskill in his proper person and being by the said sheriff sett to the Barr but had nothing to Object that was Materiall wherefore he had not burnt his tobacco according to Law but is willing to pay his fine for the fact afd Wherefore it is Considered by the Court here that the afd Dennis Driskill pay unto his Lordship the Lord propry for his fine for and by Occasion of the premisses afd twenty Shillings Curr.t money of Maryland afd and that he be taken &a Philip Carter of Somerset County planter being attached by the Sheriff of Somerset County for not not appearing at Last November Court held for Somerset County at dividing Creek he being Legally Somoned thereto Now hereat this day to witt the Sixteenth day of March anno Dom 1735 Came the said Philip Carter in his proper person and being by the said sheriff sett to the barr but had nothing to Object that was Materiall wherefore he had not burnt his tobacco according to Law but is willing to pay his fine for the fact afd Wherefore it is Considered by the Court here that the said Philip Carter pay unto his Lordship the Lord Proprietary for his fine for and by Occasion of the premisses afd forty Shillings ^Curr.t money^ but afterwards the same Philip Carter of the Same Fine is by the Court ^here^ acquitted and discharged and ordered to give Security for fees but for want thereof he is Committed into the Custody of the Sher of Somerset County thereto remaine &.a the said Sheriff to witt Jos: McClester Gent by Huett Nutter his deputy present ^herein Court^ took Charge of the said Philip Carter accordingly &a John Goldsmith of Somerset County Came hereinto Court in his proper person according to a Certain Writt of attachment against him Issued for not appearing at November Court Last to answer his not burning of tobacco according to act of assembly in Such Case made and provided and for as much as the said John Goldsmith had nothing to Object that was Materiall wherefore he had not burnt his tobacco according to Law but was willing to pay his fine for the fact afd Wherefore it is Considered by the Court here that that the said John Goldsmith pay unto his Lordship for his fine for and by occasion of the premisses afd twenty Shillings Curr.t money of Maryland and that he be taken &a |
