166 that thereof he Should not fail &a Att which said third tuesday of november to witt the Eighteenth day of the Same month anno Dom One thousand Seven hundred & thirty five being the day of the Return of the said Writt Cometh the said John Asson by Thomas Bluet his attorney and the Sheriff of Somerset County to whom the foregoing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed in these words Following vizt Cepi Corpus p Joseph MaClester Sher Whereupon Came here into Court the said Ann Draper in her proper person and thereupon at the prayer of the said John Asson by his attorney afd the said Ann Draper is adjudged to give Speciall Bail to the action afd Whereupon a Certain William Draper late of Somerset County planter present herein Court in his proper person undertooke for the said Ann Draper and assumed upon himselfe [Likewise the said Ann Draper assumed upon herself] that if in Case the said John Asson should recover Judgment in the plea aforesaid against the said Ann Draper or that the said Ann Draper should be therein Convict that than she the said Ann Draper should pay the Judgment of the Court thereon or render her body in execution of such Judgment to the prison of the Sheriff of somerset County in Satisfaction thereof or that he the same William Draper will do the same for her Whereupon the afd Ann Draper admrx of the same Alexander Draper decd by Robert Jenckins Henry her attorney Cometh and Saving to herselfe all manner of advantages to the witt afd prays Leave thereof to Imparle hereuntill next Court and she hath it & the same day is given to the afd John herealso &a Att which said next Court to witt the Sixteenth day of march ann.o Dom One thousand Seven hundred and thirty five Came again as well the afd John asson as the aforesaid Ann Draper by their attorneys afd and whereupon the afd John Asson then and there his writt afd against the afd Ann Draper did not prosecute with effect but Voluntarily permitted his Suit to be discontinued Therefore afterwards to witt the Same day by discretion of the Justices here were adjudged the same Ann Draper admrx of the afd Alexander Draper 201 pounds of tobacco for her Costs and Charges by her about her defence in that part sustained according to the form of the Statute in such Case Lately made and provided & the afd John in Mercy and that the afd Ann have thereof Execution &a Peter Frazer of Somerset County being Somoned to appear at this Court to answer his not Burning of tobacco according to act of assembly in such Case made and provided (&.c) |
