165 date the 27.th day of November 1735 Impowering us to Examine Evidences in relation to the bounds of a Certain Tract of Land called maidens lott in the possession of John Gillis in Complyance whereof after having given publick notice according to act of assembly on the fifteenth day of Janr 1735/6 we meet on the said Land to Execute the said Commission and the following depositions was Taken Before us James Caldwell (seal) Robt Givan (seal) The depositions ^of^ John Wilson ageed fifty one years or thereabout being sworn deposeth and sayeth that about twenty years by past his father old Thomas Willson Told him that there was a Bounder of Maidens Lott standing near the waden place of Barren Creek and further sayeth not The deposition of William Young aged forty eight Years or thereabouts being sworn on the holy Evangelist of almighty God deposeth and Saith that about thirty years by past this deponents Mother was possest of a tract of Land Called Wilsons Mistake and John Leverton who was owner of a Tract of Land Called maidens Lott agreed to Joyne their paster fences and and each of them was to fence as far as their one Land went and Joyne on the devision and in order to know where the devision was ^this^ deponant sayeth that the af.d John Leverton Took a pockit Compas and went to a white Oake standing about thirty eight yards Below the waden place of Barran creek marked with sixteen notches by the path side and said that that tree was the Devision Between the deponants mother and him and run a line from the said tree for the devision and accordingly they Joyned their fence on the line this deponant further sayeth that some time after he the dep^o^nant was possest of the Land Called Willsons Mistake and that he never Clamed or sold any Land below the bounder before mentioned but always allow'd that tree to be the devision between the two tracts and understood it to be the second Bounders of maidens Lott and further sayeth not The deposition of Soloman Right Aged thirty one years or there about being sworn deposeth and sayeth that about four years by past he the deponant was taken with his father old Edward Right Concerning the bounders of a tract of Land Called Wilsons mistake and that his father told him that the first bounder of the af.d tract of Land stood on the wading place point and that it was either a stooping tree or a forked tree and further sayeth not
might have her body before our Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of November then next to answer unto John Asson of a plea of trespass upon the Case &.a and that |
